Ongoing through the RTI application, CPIO’s reply and First Appeal filed by the appellant, it is observed that the Appellant has asked for the procedure to access online complaint/second appeal filed on the rti-online portal (a) to get ensured delivery of copy to CPIO, FAA which is mandatory for admissibility of complaint/second appeal (b) to submit further rejoinders.
The CPIO, in respect to point no. (a) of the RTI Application, informed the process of submitting online complaint/second appeal to the Commission and in respect to point no. (b) the process of submitting rejoinder was intimated to the Appellant. On observing the information provided against point no. (a), the undersigned is of the opinion that the CPIO has not actually responded to the query against point No. (a) of RTI Application, as has been stated by the Appellant in his First Appeal Petition. Therefore, the CPIO, Sh. Amit Tiwari, M&R section is hereby directed to revisit the information asked for by the Appellant against point no. (a) of the RTI Application and send a suitable reply as per the provision of the RTI Act, 2005 within 15 days after receipt of this order. |

Ongoing through the RTI application, CPIO’s reply and First Appeal filed by the appellant, it is observed that the Appellant has asked for clarification/interpretation of the Rights of a complainant of getting information, regarding the departmental proceedings, initiated on the basis of the complaint made by himagainst a serving government employee, especially when, the information asked for is exempted u/s 8(1)(j) of RTI Act, 2005.
The CPIO, in his reply dated 07.09.2020, advised the Appellant to “go through the RTI Act, 2005 and RTI Rules, 2012 available on public domain.†It is worth mentioning here that under the provisions of Section 2(f) of the RTI Act, only such information, as is available and existing and held by the public authority or is under control of the public authoritycan be provided by a PIO. The PIO is also not required to interpret information or furnish replies to the hypothetical questions. Such type of matter is adjudicated only by CIC or concerned SIC in respect to the Complaint or 2nd Appeal, received u/s 18 or 19(3) of RTI Act, 2005 respectively. Accordingly, no further intervention is required on the part of FAA in this matter. |
