Likewise, against queries against point Nos. 2 and 3, the Appellant has been informed the total amount of penalty imposed and recovered by the Commission during the specific period, as has been compiled in Annual Report of the Commission. As far as the further details regarding imposition of penalty, are concerned, the information is available in decisions of the Commission, which are available on Commission’s website in public domain and can be obtained from there by any citizen. It is worth mentioning that once the information has been provided in public domain and on the website, the information is no longer held by or under the control of any public authority and hence, is no longer accessible under ‘Right to Information’. Hence, the information provided by the CPIO is factual in nature and in consonance with the provision of the RTI Act, 2005.
