695 CICOM/A/2019/60093 AJITKUMAR VASANTRAO SONTAKKE 17-06-2019 In the appeal, appellant has stated that it appears that Video/Audio recordings are done by NIC, therefore, CPIO should have transferred his RTI application u/s 6(3) of the RTI Act to the concerned CPIO of NIC for providing information. In this regard, Shri TBJS Rajappa, CPIO, RTI Cell has been called for who informed that NIC is providing facility of video conferencing to the CIC. Further, Commission has not authorized NIC for recording of hearing. NA
696 CICOM/A/2019/60088 AJITKUMAR VASANTRAO SONTAKKE 15-06-2019 In the appeal, appellant has stated that “The following deficiencies are seems as per reply of CPIO Mr. K L Das vide letter dated 22 May 2019 as uploaded online: (ONE) “In reference of query no 1 the certified true copy of following annexures which annexed with show cause reply dated 04.12.2018 were not provided by PIO Cum Dy Registrar Mr K L Das at CIC Viz ie The certified true copy of medical report & six letters dated 06.09.2018 & 11.09.2018 addressed to custodian of information ie chairman & convener of medical board written by Sr. AO H & Astt AO M PGI Chandigarh in response of compliance of CIC orders in appeal case CIC/PGIME/C/2017/121556 for retrieve the digital CDs a part of medical records of my deceased child Yash Arora & it was non supplied contain of query no C & D till date. (TWO) In compliance of an order of commission in appeal case CIC/PGIME/2017/ 121556 The respondent authority was wrote multiple letters dated 06 Sep 2018 & 11 Sep 2018 addressed to actual custodians of such CDs ie chairman & concerned of medical board for retrieving of such CDs as non supplied contain of RTi Query C & D accordingly he directed to the custodian of such CDs & its submission in Honorable commission & Appellant within 3 days as on 06 September 2018 & 11 September 2018. As per my present online RTI petition dated 13 May 19 I also sought the copy of above digital CDs or its update status as on 31.01.2019 provided to commission by PGI Chandigarh vide letters 31.01.2019 in sequence of the efforts to retrieve the non supplied contain ie digital CDs through letters dated 06.09.2018 & 11.09.2018 addressed to its custodian as attached with this appeal which were not provided by PIO Mr K L Das who wrongly or mistakenly informed that such information is not available. PRAYER SOUGHT In response to my query no 1 & 3 kindly direct to PIO Mr K L Das to provide certified true copy of each six letters dated 06.09.2018 & 11.09.2018 herein efforts were made to retrieve the non supplied contain information ie digital CDs along with its copy of CDs as part of medical record of my deceased child Yash arora may supplied to commission as described in such letters as attached if such CDs were not provided to Honorable commission by PGi Chandigarh then kindly provide its update status on 31.01.2019 provided to Honorable commission by respondent PGI Chandigarh vide letter 31.01.2019 Copies of letters dated 06.09.2018 & 11.09.2018 are attached which annexed with show cause reply dated 04.12.2018 which certified true copies were not provided by PIO also.” In view of the above, direction is given to Shri K.L. Das, CPIO & DO to IC(BJ) to re-visit the RTI application and provide suitable response to the appellant within 2 weeks from the date of receipt of this order. NA

698 CICOM/A/2019/60086 AJITKUMAR VASANTRAO SONTAKKE 10-06-2019 The matter has been enquired from Shri Kishore Kumar Pukhral, CPIO (Legal Cell) who informed that no information is available other than that a report on Transparency Audit of disclosures u/s 4 of the RTI Act is available on the CIC’s website. Moreover, appellant has not sought any information but made a query in the RTI application and query do not falls under the definition of ‘information’. In view of the above, the appeal is disposed off. NA

700 CICOM/A/2019/60085 AJITKUMAR VASANTRAO SONTAKKE 06-06-2019 Shri K.L. Das, CPIO & DO to IC(BJ) informed that the correct date of diary No.167657 is 15.11.2018, which has been mentioned as 15.11.2019 due to typographical error. He further informed that he has provided information on Points 2 & 3 as per record available with him. The information furnished by the CPIO seems to be appropriate and factual, therefore, no intervention is required on the part of the FAA, in the matter. NA
