In this regard it is mentioned that If no reply is received within the given time limit under RTI Act, 2005 against your RTI application from the concerned Department or you are not satisfied with the reply, you may file first appeal in the same Public Authority wherein you have filed your RTI application. In case no reply is received against your First Appeal also, then within 90 days of filing of First Appeal you may file the second appeal in Central Information Commission. The Replies to the Question raised by you at Point no 1 and 2 are as under:
1. As per RTI Act 2005 Central Information Commission only deals with Second Appeals and
Complaints against Central Public Authorities. Since your matters relates to a State Public
Authority it was forwarded to Uttar Pradesh Information Commission which is an independent
Commission and does not fall under Central Information Commission hence Central
Information Commission cannot take any cognizance on complaint made against a State
Information Commission
2. In view of reply a Point 1 Central Information Commission cannot initiate or take action
against UP Information Commission. You may approach UP State Information Commission and
file your complaint there. |
