The appellant has filed three online first appeals No.CICOM/A/2018/60041, CICOM/A/2018/60042 and CICOM/A/2018/60043 against same RTI application. On perusal of the said appeals, it is observed that CPIO, RTI Cell has transferred RTI application to two CPIOs and sought information u/s 5(4) from Registrar, CIC for providing information and whenever appellant received a reply, filed first appeal against it, therefore, three first appeals filed online against same RTI application.
In the appeals, the appellant has stated that reply received from the CPIOs and Registrar seems to be incomplete, misleading and false. Shri S.C. Sharma, CPIO quoted wrong RTI No.CICOM/R/2018/20129/1. Further, reply of Shri S.C. Sharma and Registrar are unauthentic as no seal or any letter number quoted in the reply. Shri S.C. Sharma has informed that due to typographical error in place of CICOM/R/2018/50129/-, it has been typed wrongly as CICOM/R/2018/ 20129/1.
Besides above, appellant has not mentioned as to why replies of the CPIOs and Registrar are incomplete, misleading and false. On perusal of the RTI application and replies of the CPIOs & Registrar, it is observed that reply furnished is appropriate except on Point 5. As regards information furnished against point 5 is concerned, it is further clarified that telephonic hearing is not conducted as a normal hearing mode. The same is activated only when video conferencing fails or in other exigencies and no data is maintained in such regard.
As regards unauthentic reply of Shri S.C. Sharma and Registrar is concerned, Shri Ashok Kumar Sharma, CPIO, RTI Cell is directed to provide true copy of the replies as per DoPT OM No.10/1/2013-IR dated 6th October, 2015 to the appellant within 1 week from the date of receipt of the order. |

The appellant has sought 2 points information in respect of order dated 04.06.2009 in case No.CIC/AT/A/2008/01386. Shri K.L. Das, CPIO & DO to IC(BJ) has informed the appellant that the case file is not available in the registry and also not available in the Record Room. Aggrieved with response, appellant has filed the appeal.
On perusal of the RTI application, reply of the CPIO and appeal, it is observed that the case is very old and it may not be available in physical form, and may be available in scanned document (pdf file). Direction is accordingly given to Shri K.L. Das, CPIO & DO to IC(BJ) to take the assistance of JS(MR) to get the scanned document and provide information to the appellant within two weeks from the date of receipt of the order. |
