1222 CICOM/A/P/23/00071 Ms. ROOP AVTAR KAUR 21-04-2023 आर. टी. आई. आवेदन, प्रदान की गई सूचना एवं प्रथम अपील का अवलोकन करने पर पाया गया कि अपीलकर्ता के आर.टी.आई. आवेदन सं. CICOM/R/P/23/00119 में सूचना मांगी थी जिसके प्रतिउत्तर में केंद्रीय जन सूचना अधिकारी द्वारा प्रेषित की गई सूचना, सूचना का अधिकार अधिनियम के प्रावधानों एवं मांगी गई सूचना के अनुसार ही है। अतः सूचना के अधिकार अधिनियम की धारा 2 (च) के प्रावधानों के अनुसार एक जन सूचना अधिकारी केवल सम्बंधित लोक प्राधिकरण के रिकॉर्ड में एक सामग्री के रूप में उपलब्ध सूचना ही प्रदान कर सकता है। अतः केंद्रीय जन सूचना अधिकारी द्वारा प्रदान की गई सूचना तथ्यात्मक है और इसमें प्रथम अपीलीय अधिकारी के हस्तक्षेप की कोई आवश्यकता नहीं है। NA
1223 CICOM/A/P/23/00068 Ms. ROOP AVTAR KAUR 19-04-2023 आर. टी. आई. आवेदन, प्रदान की गई सूचना एवं प्रथम अपील का अवलोकन करने पर पाया गया कि अपीलकर्ता के आर.टी.आई. आवेदन सं. CICOM/R/P/23/00139 में सूचना मांगी थी जिसके प्रतिउत्तर में केंद्रीय जन सूचना अधिकारी द्वारा प्रेषित की गई सूचना, सूचना का अधिकार अधिनियम के प्रावधानों एवं मांगी गई सूचना के अनुसार ही है। परन्तु आपने अपनी प्रथम अपील में यह कहा है कि अभी तक कोई सूचना प्राप्त नहीं कराई गई। जबकि केंद्रीय जन सूचना अधिकारी द्वारा पत्र दिनांक 03.04.2023 के द्वारा सूचना भेजी जा चुकी है। केंद्रीय जन सूचना अधिकारी द्वारा दी गई सूचना, दिनांक 03.04.2023 की प्रति, प्रथम अपील के आर्डर के साथ संलग्न की जा रही है I अतः केंद्रीय जन सूचना अधिकारी द्वारा प्रदान की गई सूचना तथ्यात्मक है और इसमें प्रथम अपीलीय अधिकारी के हस्तक्षेप की कोई आवश्यकता नहीं है। NA

1228 CICOM/A/E/23/00134 Ms. ROOP AVTAR KAUR 17-04-2023 Ref RTI No.- CICOM/R/E/23/00281 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that “CAN YOU PLEASE PROVIDE STATE WISE AND CATEGORY WISE VACANCIES FOR THE POST OF SENIOR ASSISTANT FOR SSC CGL 2022 EXAMINATION IN YOUR DEPARTMENT..AND ALSO PROVIDE ME MODE OF CRITERION FOR SELECTION REGARDING THIS POST IF SOMEONE GET THIS JOB THROUGH SSC CGL 2022 EXAMINATION.” DECISION OF THE FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. As per Section 2(f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collate information that is not a part of the record. Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act, 2005. Hence, no intervention is required on behalf of the FAA in this matter. The appeal is disposed of accordingly. NA
1229 CICOM/A/E/23/00133 Ms. ROOP AVTAR KAUR 16-04-2023 Ref RTI No.- CICOM/R/E/23/00178 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that As per Rule 19(9) of the RTI Act, 2005, the Central Information Commission or State Information Commission, as the case may be, shall give notice of its decision, including any right of appeal, to the complainant and the public authority. I. being the 2nd Appellant, received the decision of the Honorable Information Commission against the Second Appeal No.: CIC/ERAIL/ A/2022/610702_UM dated 28.03.2023. But nothing has been mentioned therein regarding right to appeal against the order of the Honorable Commission. Considering above, it was requested to provide the following: 1. The Authority before whom the Appeal against the decision of the Honorable Commission can be filed by the aggrieved party, 2. The time limit for filing such Appeal against the decision of the Honorable Commission, 3. Mode of filing such appeal. Though the stipulated time is over, no information has been provided to me. Kindly arrange to provide the above information. DECISION OF THE FIRST APPELLATE AUTHORITY: The First Appeal and the RTI application have been perused. 1230 CICOM/A/E/23/00132 Ms. ROOP AVTAR KAUR 16-04-2023 Ref RTI No.- CICOM/R/E/23/00156 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that “Request to FAA 1. Request FAA to please provide me with the complete and updated information as requested in my RTI application on all the points and in compliance with the various Section(s) viz. Section 7(1), 7(2), 7(3)(a), Section 7(6), Section 5(4) & Section 6(3) of the RTI Act,2005. of the RTI Act,2005. 2. Infact, with such casual approach of CPIO, the RTI applications are appealed with FAA’s resulting in undesirable workload on FAA because of the casual approach / inaction of CPIO, and as such a strong message needs to be sent to such officials by levying the punitive and disciplinary penalties against them. FAA is requested to take suitable action against CPIO who didn’t provide me with the requested information and hence liable for penalty under section 20(1) & 20(2) of RTI Act,2005. So, FAA is requested to please take necessary action against PIO. 3. It is also requested to FAA to impart training to CPIO designated officials as mentioned in Section 19(8)(a )(v) of the RTI Act,2005, which says that “In its decision, the Central Information Commission or State Information Commission, as the case may be, has the power to— require the public authority to take any such steps as may be necessary to secure compliance with the provisions of this Act, including— by enhancing the provision of training on the right to information for its officials;” 4. Request FAA to put capable and responsible public servants as CPIO, so that they could diligently discharge their responsibilities as CPIO. 5. Please issue directions / instruction to the PIO that the Govt Circulars are followed by Public Servants also, as laws and rules are not only made for general public of this Country but also for the Public Servants. I am specifically talking about OM No. 10/1/2013-IR Dated 6th October,2015, issued by DoPT, Ministry of Personnel, PG & Pension, Govt of India, New Delhi. PIO is also to be tried under disciplinary proceedings for not adhering to OM’s and responsible for repeatedly insubordination.” DECISION OF THE FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. CPIO (DR to CIC-YS) is directed to revisit the RTI application and provide point-wise information as per available records as per the provisions of the RTI Act, 2005 by 19.05.2023. The appeal is disposed of accordingly. NA
