DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal petition, RTI application and CPIO’s reply have been perused. CPIO (IC-SP) has provided information as per the records of the Commission. As per Section 2(f) of RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collect information that is not a part of the record. He is also not required to interpret information or decision of CIC. (RTI) NIRDPR towards appeal dated 22-03-2021 and 23-08-2021 under provision of Section 19(1) of the RTI Act and according to Appellant a tentative figure of 147 Nos. of his 2nd Appeals are of pendency with the Commission and he is not getting the position regarding the same. DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal petition, RTI application and CPIO’s reply have been perused. The CPIO-CIC has provided information as per the records of the Commission As per Section 2(f) of RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collect information that is not a part of the record. In the instant case, the information sought by the Appellant in his RTI application is provided by the CPIO and the grounds of First Appeal stated by the Appellant are beyond the purview of the FAA. 1950 CICOM/A/E/21/00260 Ms. ROOP AVTAR KAUR 09-12-2021 Ref RTI No.- CICOM/R/E/21/01001 GROUNDS FOR FIRST APPEAL: The appellant has submitted First Appeal stating: It is submitted that the information provided by the CPIO is misleading information. It may not be out of place to mention here that I had not submitted my submissions to CIC on 1st October, 2021 either through linked provided or through post. The CPIO has not provided the date on which submissions of the CPIO Department of Revenue was received off line i.e. by post. I must inform that I had submitted my submissions on 14th October, 2021 vide linked dy. No.648490 and also additional submissions on 19th October, 2021 vide linked dy. No.649311 dated 19.10.2021. I had not sent any communication to CIC on 1st October, 2021 as indicated in reply to point (ii) of above which is misleading information on the ground that I have not been provided the date on which submissions from CPIO Department of Revenue was received off line. The above information will help me to expose CPIO of the DoR. In respect of reply to point (ii), I must be provided specific information with regard to mode of submissions made by the CPIO of Department of Revenue with dated on which it was received through link paper as well as through off line as requested in point (i) above. 2. Since the undersigned is working on manipulative tricks adopted by officers/officials to mislead their seniors, it is requested that I may be given personal hearing to represent my case before your honour. I must inform to Hon’ble FAA despite letter from D.R, CIC, the CPIO of the Department of Revenue not share their submissions with me whereas I had sent my submissions to CIC dated 14th October, 2021 and also 19th October, 2021 were also shared with CPIO of the Department of Revenue through mail. A copy of the mail was also addressed to D.R., CIC. The letter dated 1st October, 2021 sending on line that is after 12 days is also part of manipulative tricks from CPIO of the DoR. The date on which latter dated 1.10.21 from the CPIO of the Department of Revenue received by CIC off line will also help me to expose CPIO of the Department of Revenue in public interest. DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal petition, RTI application and reply given by CPIO of CIC have been perused. As per Section 2(f) of RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collect information that is not a part of the record. He is also not required to interpret information or decision of CIC. Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act, 2005. Hence, no intervention is required on behalf of the FAA in this matter. The appeal is disposed off accordingly. NA
