CICOM/R/E/20/01060 के बिंदु सं. 1 एवं 2 के प्रतिउत्तइर में केन्द्रीय जन सूचना अधिकारी द्वारा प्रदान की गई सूचना के विरुद्ध प्रथम अपील दाखिल की गई है । आर.टी.आई. आवेदन सं. CICOM/R/E/20/01060 के बिंदु सं. 1 एवं 2 माध्यम से निम्नलिखित सूचनाएं मांगी गई थी:- 1. यदि किसी सूचना आयुक्त को यह अधिकार दिया गया है कि वह पूर्व में कार्यरत सूचना आयुक्त के आदेश को निरस्त कर सकता है, तो संबंधित आदेश/नियम की प्रमाणित छाया प्रति उपलब्ध कराने का कष्ट करें । 2. यदि उक्त वर्णित कोई आदेश/नियम उपलब्ध नहीं है तो यह सूचना दी जाए कि यदि वर्तमान सूचना आयुक्त के द्वारा पूर्व सूचना आयुक्त के द्वारा पारित आदेश को निरस्त कर दिया गया है, तो संबंधित सूचना आयुक्त के खिलाफ जो अधिकारी कार्यवाही कर सकते है, उनका नाम, पदनाम एवं पूरा पता बताया जाए । 2. आर.टी.आई. आवेदन के बिंदु सं. 1 एवं 2 के संदर्भ में श्री राम कुमार, केन्द्रीय जन सूचना अधिकारी द्वारा निम्नलिखित सूचना प्रदान की गई है:- बिंदु सं. 1 एवं 2 वांछित सूचना उपलब्ध नहीं है । 3. अपीलकर्ता ने प्रथम अपील आवेदन में उल्लेख किया है कि ‘केन्द्रीय जन सूचना अधिकारी ने अपने पत्र दिनांक 14.01.2021 के द्वारा मेरे आवेदन पत्र के बिन्दु सं.01 एवं 02 की सूचना यह कहकर कि वांछित सूचना उपलब्ध नहीं है, उपलब्ध नहीं कराई है’ एवं अनुरोध किया है कि ‘पूर्ण सूचना साक्ष्यों सहित उपलब्ध कराने का कष्ट करें तथा समय से साक्ष्यों सहित सूचनाएं उपलब्ध ना कराने के संबंध में जन सूचना अधिकारी के विरुद्ध आवश्यक कार्यवाही करने की कृपा करें’ । 4. आर.टी.आई. आवेदन, प्रदान की गई सूचना एवं प्रथम अपील आवेदन का अवलोकन करने पर पाया गया कि अपीलकर्ता के आर.टी.आई. आवेदन के बिंदु सं. 1 एवं 2 के संदर्भ में, श्री राम कुमार, केन्द्रीय जन सूचना अधिकारी द्वारा प्रदान की गई सूचना, सूचना का अधिकार अधिनियम, 2005 के प्रावधानों के अनुसार ही है । यहॉं यह उल्लेरखनीय है कि सूचना का अधिकार अधिनियम, 2005 के तहत जन सूचना अधिकारी केवल वही सूचनाएं प्रदान कर सकता है जो दस्तावेज में उपलब्ध है, जन सूचना अधिकारी से सूचनाएं निर्मित करने या इकट्ठा करने की अपेक्षा नहीं की जाती है । अत: इसमें प्रथम अपीलीय अधिकारी के हस्तक्षेप की कोई आवश्‍यकता नहीं है । NA

POINT-WISE RTI-REPLY GIVEN BY SH.A.K.ASSIJA, CPIO ON 11.12.2020:- 1. You have sought the information with regard to action taken note on second appeal having file no. CIC/CVCOM/A/2018/167683 from the date of filing till date. It is informed you that no such record available. Further, it is stated that once a case is filed in the Commission, no day-to-day action is required to be taken on the same. Only when the hearing of the case is fixed, parties to the case are intimated by sending the notice of the hearing and after the hearing of the case, Order is issued by the Commission. 2. CPIO-IC(VN) has responded on all queries including 1&2. Point no. 1&2 do not even pertain to IC(VN) as Appeals/Complaints w.r.t. CVC are not handled by them. Improper information with illogical observation/comments supplied against point no.3-8. I did not receive any signed copy of reply even after almost 80 days of filing of RTI Application. Requested FAA to take appropriate action and provide point-wise reply.” IV. DECISION WITH REASONS:- As per Section 2(f) of RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collect information that is not a part of the record. The applicant has been provided point-wise factual information by CPIO of CIC as per the provisions of RTI Act, 2005. As the replies/decisions in respect of online RTI applications and First Appeals are uploaded directly on the RTI Portal, no signed copy of CPIO reply/FAA decision is issued separately to the applicants/appellants. CICOM/R/E/20/01074 के बिंदु सं. 2, 3, 4 एवं 6 के प्रतिउत्तर में केन्द्रीय जन सूचना अधिकारी द्वारा प्रदान की गई सूचना के विरुद्ध प्रथम अपील दाखिल की गई है । आर.टी.आई. आवेदन सं. CICOM/R/E/20/01074 के बिंदु सं. 2, 3, 4 एवं 6 माध्यम से निम्‍नलिखित सूचनाएं मांगी गई थी:- 2. 01-01-2017 से लेकर आजतक के दौरान CIC मे फैसीलीटेशन डेस्क पर कार्यरत दोनों आउट्सोर्स DEO की Educational Qualification के बारे में जानकारी प्रदान कीजिए । 3. 01-01-2017 से लेकर आजतक के दौरान CIC मे फैसीलीटेशन डेस्क पर कार्यरत दोनों आउट्सोर्स DEO दारा नियमानुसार रिसेप्‍सनिष्‍ट के कोर्स का सर्टिफिकेट या डिप्लोमा किसी मान्यता प्राप्त संस्थान से प्राप्त किया गया है । यदि हॉं तो मान्यता प्राप्‍त संस्थान के नाम का उल्ले‍ख रिसेप्‍सनिष्‍ट के कोर्स के सर्टिफिकेट या डिप्लोमा प्राप्ति के वर्ष सहित कीजिए । 4. 01-01-2017 से लेकर आजतक के दौरान CIC में फैसीलीटेशन डेस्क पर कार्यरत दोनों आउट्सोर्स DEO से CIC Administration दारा CIC की कार्य प्रणाली की आवश्यकता को छोड़ कर किस नियम के आधार पर जन सम्पर्क अधिकारी (फैसीलीटेशन डेस्क) का कार्य करवाया जा रहा है । जबकि जन संपर्क अधिकारी के कार्य की प्रकृति (Nature of work) DEO के Nature of work से बिल्कुल अलग है । 6. 01-01-2017 से लेकर आजतक के दौरान CIC मे फैसीलीटेशन डेस्क पर कार्यरत दोनों आउट्सोर्स DEO से जन सम्पर्क अधिकारी (फैसीलीटेशन डेस्क) का कार्य करवाने के लिए CIC Administration दारा DOPT से पूर्व अनुमति कब प्राप्त की गई थी । 2. आर.टी.आई. आवेदन के बिंदु सं. 2, 3, 4 एवं 6 के संदर्भ में श्री सी. विनोद बाबू, केन्द्रीय जन सूचना अधिकारी द्वारा निम्नलिखित सूचना प्रदान की गई है:- बिंदु सं. 2 एवं 3 रिकार्ड में बिंदु सं. 2 और 3 के संदर्भ में कोई सूचना उपलब्ध नहीं है, बहरहाल सुविधा डेस्क पर दोनों आउटसोर्स DEO की नियुक्ति M/s बी. के. इंटरप्राइजेज (जनशक्ति सेवा प्रदाता) के द्वारा की गई है । बिंदु सं. 4 बिंदु 4 में कोई जानकारी नहीं मांगी है बल्कि प्रश्न् पूछा गया है । बिंदु सं 6 आर्डर की प्रतिलिपि संलग्न है । 3. आर.टी.आई. आवेदन, प्रदान की गई सूचना एवं प्रथम अपील आवेदन का अवलोकन करने पर पाया गया कि अपीलकर्ता द्वारा आर.टी.आई. आवेदन के बिंदु सं. 2, 3, 4 एवं 6 में जो सूचना मांगी गई थी, श्री सी. विनोद बाबू, केन्द्रीय जन सूचना अधिकारी द्वारा सूचना का अधिकार अधिनियम, 2005 के प्रावधानों के अनुसार प्रदान कर दी गई है । उल्लेखनीय है कि सूचना अधिकार अधिनियम की धारा 2 (च) के प्रावधानों के अनुसार एक जन सूचना अधिकारी केवल संबंधित लोक प्राधिकरण के रिकार्ड में एक सामग्री के रूप में उपलब्ध सूचना ही प्रदान कर सकता है । अत: केन्द्रीय जन सूचना अधिकारी द्वारा प्रदान की गई सूचना तथ्‍यात्‍मक है और इसमें प्रथम अपीलीय अधिकारी के हस्ताक्षेप की कोई आवश्यकता नहीं है । NA

The appellant while referring the order of the Commission in file No. CIC/CICOM/C/2017/ 181825/SD, has sought information in his RTI application No. CICOM/R/E/20/00804 dated 08.10.2020 as follows. “Copy of the said order has been served to whom (all CPIOs) containing 1. Name of CPIOs with respective Department. 2. Served copy of order on (date) 3. Proof of served copy of order to CPIOs” II. The CPIO Shri Ram Kumar has replied vide letter dated 5.11.2020 as under. “Perusal of the case file number mentioned by you in your above RTI application reveals that it pertains to some other person. Accordingly, in accordance with section 8(1)(h) of the RTI Act, 2005, third party information cannot be disseminated.” III. The appellant in his First Appeal dated 01.02.2021 has appealed to provide the information as requested in his RTI application. IV.
