503 CICOM/A/E/24/00225 Ms. ROOP AVTAR KAUR 20-07-2024 Ref RTI No. - CICOM/R/E/24/00883 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that "On a prior request the former Legal Cell CPIO had allowed inspection of F. No. CIC/Legal/2008/020. On 16.06.24 I made RTI Online request dt. 16.06.24 No. CICOM/R/E/24/00883 for payment link for copies from the file (in form of scanned copies by email instead of photocopies by post for avoiding avoidable wastage of resources). On 11.07.24 CPIO disposed of my request without payment Link, with online Reply saying: the copies of the noting part pages are 18 in number, you may remit an amount of rupees 36/- with the appropriate link available in the additional fees coloumn on the RTI portal. CPIO also disposed of another request without payment Link the same day. I promptly made RTI Online request dt. 12.07.24 for payment Link, informing CPIO that it cannot be created in the Citizen Module of RTI Online. On 19.07.24, however, CPIO again disposed of without providing the Link, with another Reply arguing that I have to create it. Text of request dt. 12.07.24 and printout of Reply dt. 19.07.24 are reproduced on page-1 of the attached pdf. GROUNDS: Information has been denied by denying RTI Online payment link for the copies offered. CPIO has apparently not familiarised himself with RTI Online modalities, as I have been twice told to create the required link whereas: a. Payment link can only be used (and NOT created) in the Citizens Module of RTI Online. (User Manual page 20 and FAQ no.6 available on Citizens Module are reproduced on second page of the attached pdf along with status form of an earlier request showing the Link provided by the former Legal Cell CPIO.) b. Payment Link has to be generated by CPIO in the CPIO Module of RTI Online - by entering the amount demanded after selecting the ADDITIONAL PAYMENT REQUIRED FOR INFORMATION (and NOT the REQUEST DISPOSE OF option) in the drop-down menu for Decision. REQUEST: Please ask the CPIO to provide the copies already offered (in the requested form of scanned copies by email instead of photocopies by post) free of charge u/s 7(6). If you find that the provision u/s 7(6) does not apply, please ask CPIO to send me an email asking me to make another RTI Online request for the payment link and promising that he will provide the link (by using the ADDITIONAL PAYMENT REQUIRED FOR INFORMATION Decision option in the CPIO Module of RTI Online). " DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. As mentioned by the appellant in the Grounds of First Appeal, the appellant may file another RTI online request for the payment link in respect of the information sought. CPIO in the meantime is directed to provide link for additional payment and then provide information in response to the additional payment made as per the provisions of the RTI Act, 2005. No. 11/JS(Law)/2016/CIC and sought: 1. Copy of the dissenting note dt. 06.09.2016 of IC Shri M A Khan Yusufi. 2. Copies of the noting part pages of the F. No. 11/JS(Law)/2016/CIC. 3. The subject title of the file. I specifically requested as follows: Please include link for online payment for the copies and, after I have made the payment, please provide scanned copies by email instead of photocopies by post (for avoidance of avoidable wastage of resources). On 11.07.24 CPIO disposed of my request without payment Link, with online Reply saying: the copies of the noting pages so sought in the application (point no. 1,2&3) are 11 in number, you may remit an amount of rupees 22/- with the appropriate link available in the additional fees coloumn on the RTI portal. CPIO also disposed of another request for payment link likewise the same day. I promptly made RTI Online request dt. On 12.07.24 for the Link, informing CPIO that it cannot be created in the Citizen Module of RTI Online. I respectfully urge your prompt attention to this matter and request the expeditious provision of the requested information in accordance with the provisions of the Act. " DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. As per Section 2(f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collate information that is not a part of the record. As per the Section 6(1) of the RTI Act, 2005, the applicant shall file information request with the concerned Public Authority which holds the information. Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act,2005. Hence, no intervention is required on behalf of the FAA in this matter. The appeal is disposed of accordingly. NA

CICOM/R/E/24/00957 के प्रतिउत्तर में केंद्रीय जन सूचना अधिकारी द्वारा प्रेषित की गई सूचना सूचना का अधिकार अधिनियम के प्रावधानों एवं मांगी गई सूचना के अनुसार नहीं है। अतः केंद्रीय जन सूचना अधिकारी (DR to CR) को निर्देश दिया जाता है कि इस आदेश के प्राप्ति के दस दिन के भीतर आर.टी.आई. आवेदन सं. CICOM/R/E/24/00957 के तहत मांगी गई सूचना का अवलोकन कर अपीलकर्ता को पुनः स्पष्ट सूचना प्रेषित की जाये। NA

CICOM/R/E/24/00775 के प्रतिउत्तर में केंद्रीय जन सूचना अधिकारी द्वारा प्रेषित की गई सूचना, सूचना का अधिकार अधिनियम के प्रावधानों एवं मांगी गई सूचना के अनुसार ही है। उल्लेखनीय है कि सूचना अधिकार अधिकारी अधिनियम की धारा 2(च)के प्रावधानों के अनुसार एक जन सूचना अधिकारी केवल सम्बंधित लोक प्राधिकरण के रिकॉर्ड में एक सामग्री के रूप में उपलब्ध सूचना ही प्रदान कर सकता है। अतः केंद्रीय जन सूचना अधिकारी द्वारा प्रदान की गई सूचना तथ्यात्मक है और इसमें प्रथम अपीलीय अधिकारी के हस्तक्षेप की कोई आवश्यकता नहीं है। NA
