542 CICOM/A/E/24/00198 Ms. ROOP AVTAR KAUR 13-06-2024 Ref RTI No. - CICOM/R/T/24/00043 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that " FAA Central Information Commission New Delhi Providing Incomplete and Misleading Information Dear Madam, 1. The CPIO while replying to the undersigned RTI request has not applied his mind and replied mechanically without passing information. 2. Instructions or directions pertaining supply of information with regard to appointment, process of confirmation, DPCs, DPEs and award of tenders should have been provided. Merely providing the link of decisions is not complete action. CPIOs at CIC will evade the reply then how can we expect something more mindful from others. 3. It is a humble request to FAA to:- (a) Direct the CPIO to provide the relevant instructions, DoPT IRs and Directions explicitly. (b) Ascertain the reasons to evade the reply. (c) Action against CPIO in Sec 20(1) and 20(2) to be taken to make more them more responsible and transparent. (d) An inquiry under Sec 18 be instituted to ascertain the correct reasons for avoiding and evading reply. (e) Entries to the effect mentioned at para (c) above be made in his service book and should be considered for his future promotions. (f) Undersigned should be compensated suitably to repair the mental, physical and financial harassment meted out." DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. As per Section 2(f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collate information that is not a part of the record. As per the Section 6(1) of the RTI Act, 2005, the applicant shall file information request with the concerned Public Authority which holds the information. Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act,2005. Hence, no intervention is required on behalf of the FAA in this matter. The appeal is disposed of accordingly. NA

544 CICOM/A/E/24/00196 Ms. ROOP AVTAR KAUR 11-06-2024 Ref RTI No. - CICOM/R/E/24/00717 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that "1. I am writing to appeal the response received on 10-Jun-2024 to my RTI application number CICOM/R/E/24/00717, filed on 24-May-2024. 2. In my RTI application, I requested a certified copy of the report prepared by the Central Information Commission (CIC) on the implementation of the provisions of the Right to Information (RTI) Act, 2005, from 2022 to 2024 (both years included) which was forwarded to the Central Government. 3. However, the response I received provided a report received from various Public Authorities (PAs). 4. Grounds for Appeal: The information provided does not correspond with my original request. Section 4(1) (b) of the RTI Act guarantees access to a report prepared by a public authority if it exists. In this case, the CIC is the public authority, and the report I requested undoubtedly exists. 5. Relief Sought: Therefore, I request the FAA to direct the CPIO to provide a certified copy of the report the CIC prepared on the implementation of the provisions of the RTI Act, 2005, from 2022 to 2024 (both years included) which was forwarded to the Central Government." DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. The annual report prepared by Central Information Commission each year is available on the website of the Commission under the heading "Reports and Conventions". This report is submitted to the Government for laying before each House of Parliament as provisioned under Section 25 of the RTI Act, 2005. The appeal is disposed of accordingly. NA

Accordingly, CPIO (DR to CR) is directed to reply the RTI application as per the provisions of the RTI Act, 2005 by 01.07.2024, free of cost. The appeal is disposed of accordingly. NA
