583 CICOM/A/E/24/00169 Ms. ROOP AVTAR KAUR 15-05-2024 Ref RTI No. - CICOM/R/E/24/00516 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that "APPEAL AGAINST CRYPTIC COMMENT THAT IS INCOMPREHENSIBLE (UNRELATED TO DISCLOSURE u/s 4) CONTEXT: My 2nd Appeal No. CIC/CICOM/A/2022/663553 for direction to publish the powers and duties of all nodal officers in CIC was disposed of by Order dated 21/12/2023 advising CIC Secretary to look into the matter of updating the disclosure u/s 4 on CIC website. I had sent, by email and by speed-post, a letter dated 03.01.2024 on the subject of the said Order requesting the Secretary CIC to have the powers and duties of all nodal officers of CIC published u/s 4(1)(b)(ii) of RTI Act. The information was not published. The decision / reason for the decision to reject my request was not intimated. FACTS: On 15.04.2024 I made RTI Online request No. CICOM/R/E/24/00516 for detailed information of all of any actions taken on: (1) the email that I had sent at 10:26 PM on 05.01.2024 to secy-cic@nic.in (2) the speed-post ED522240094IN that was delivered in CIC at 1:12 PM on 05.01.2024 Point no. 2 was separately disposed of, as No. CICOM/R/E/24/00516/1, by CPIO I/c Dak Section (and I am filing separate appeal in respect of it). No. CICOM/R/E/24/00516 was disposed of by letter dated 14.05.2023 of Admin Section CPIO, saying: The email dated 5/1/2024 has been marked to the concerned task holder as per the channel. GROUNDS: A. I have specifically sought DETAILED information of ALL actions taken on the email that I sent to secy-cic@nic.in. CPIO has neither informed ALL Actions nor provided any DETAILS (e.g., when and by whom my email was opened and read, printed and put up / electronically forwarded for any further action taken / not taken, if it was archived or deleted.) B. CPIO has, instead, cryptically commented about a marking to TASK HOLDER as per CHANNEL. I am not able to access on CIC website the current publication u/s 4(1)(b)(iii) of channels. (Printout is attached of the error message: The requested page could not be found). In the previous publication, of which I have a downloaded copy, I find neither CHANNEL nor TASK HOLDER for correspondence related to advice issued to CIC Secretary in an Order of the Commission. REQUEST: I may please be provided the requested detailed information of action taken on my email (by way of, e.g., printout(s) from the secy-cic@nic.in email account and copies of any physical marking(s) or noting(s) relating to it). The TASK HOLDER and CHANNEL mentioned by CPIO may also please be comprehensibly informed. " DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. Suo-motu disclosure u/s 4(1)(b)(ii) has been updated on the CIC website. The appeal is disposed of accordingly. NA
