GROUNDS FOR FIRST APPEAL:
The Appellant submitted first appeal stating that
"CONTEXT: CIC office order dated 24.11.2016 F. No. 11/JS(Law)/2016/CIC on the subject Decision uploading procedure states, for Final Order, that: ... (b) DEOs/LCs shall upload the order in a temporary file in the software, which shall not be visible to the public. DR shall verify the correctness of the order and then upload the order through his digital signature. I have been informed in RTI process (by decisions on my request no. CICOM/R/E/24/00204 and appeal no. CICOM/A/E/24/00075) that the order is in force. FACTS: I made request dated 21/04/24 No. CICOM/R/E/24/00541 for printouts, from the CIC software for uploading Orders, of the action histories showing the uploading by DEO/LC in temporary file and the uploading by DR through his digital signature for specified Orders on my cases. CPIO disposed of my request by letter dated 29/04/24 stating that: No such information is available. GROUNDS: The generic Nil response does not say what is not available to me and why. Action history information is automatically maintained by software (e.g., in older RTI Online and CPGRAMS software) and is required to be maintained in CSMOP e-filing procedures (which would apply to Orders emanating from eBooks of statutory case files). If that is what is not available then either the CIC software is programmed to delete it or has suffered some crash and CPIO ought to have given that sort of justification for denial. If it is the requested printouts that CPIO means are not available (because they would have to be printed out) CPIO out to have invoked the disproportionate diversion of resources exception u/s 7(9) and allowed alternative access by inspecting online. REQUEST: I may kindly be informed in clear words what is not available to me - the action histories automatically and necessarily maintained or their printouts - and why. "
DECISION OF FIRST APPELLATE AUTHORITY:
The First Appeal, RTI application and reply given by CPIO of CIC have been perused.
As per Section 2(f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collate information that is not a part of the record.
Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act,2005. Hence, no intervention is required on behalf of the FAA in this matter.
The appeal is disposed of accordingly. |

The First Appeal, RTI application and reply given by CPIO is CIC have been perused.
As per section 8(1) (j) information which relates to personal information the disclosure of which has no relationship to any public activity of interest, or which would cause unwarranted invasion of the privacy of the individual may be exempted from disclosure unless the Central Public Information Officer of the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information.
Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act, 2005. Hence, no intervention is required on behalf of the FAA in this matter.
The appeal is disposed of accordingly. |
