632 CICOM/A/E/24/00130 Ms. ROOP AVTAR KAUR 23-04-2024 Ref RTI No. - CICOM/R/E/24/00275 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that "FACTS: Contracted Legal Consultants (LCs) are involved in disposal of cases in CIC. Schemes for contracting Legal Researchers / Assistants, with detailed job descriptions, are published on the respective websites of, e.g., Supreme Court, High Courts and appellate tribunals like NCLAT and DRAT. Comparable CIC Scheme is not found on CIC website. The advertisements found cursorily mention case summary preparation and LCs are present at hearings. With reference, in end-note, to the aforesaid I made request No. CICOM/R/E/24/00275 dated 02/03/2024 for COPIES of the CIC Scheme for engaging LCs on contract basis and / or of CIC instructions for LCs for (a) job of preparing case summary, and (b) job of presence at hearings. CIC Admin Section CPIO disposed of my request by letter dated 01/04/2024 stating: No such information is available. GROUNDS: First part of my request (i.e., CIC Scheme) may be concerning Admin Section. Second part / adjunct to, or alternative in absence of, Scheme (i.e., instructions for LCs) obviously concerns the (sub) registries in which LCs are posted - because different LCs conducted themselves differently at hearings held by different single benches for my cases in 2022-2024 and the Orders indicate also differences in preparation of case summaries. From the wording of letter dated 01/04/2024 it is not clear if BOTH (any CIC Scheme AND any instructions for LCs) are not available / existing in CIC. REQUEST: The wording of the decision of CPIO may please clarified in first appeal decision / CPIO may please be asked to provide clearly worded decision." DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. There is no scheme to engage Legal Consultants in CIC. However, Legal Consultants are engaged on a contractual basis to assist the Information Commissioners for hearing of Second Appeals/Complaints. The appeal is disposed of accordingly. NA

VIPIN CHAKRAWARTI 22-04-2024 On perusal of the online Appeal, RTI application and reply of the CPIO, it is observed that the information given by the CPIO is as per provisions of the RTI Act, 2005. Therefore, no further intervention is required on the part of FAA in the matter. NA

CICOM/R/E/24/00272 में सूचना मांगी थी जिसके प्रतिउत्तर में केंद्रीय जन सूचना अधिकारी द्वारा प्रेषित की गई सूचना, सूचना का अधिकार अधिनियम के प्रावधानों एवं मांगी गई सूचना के अनुसार ही है। परन्तु आपने अपनी प्रथम अपील में यह कहा है कि अभी तक कोई सूचना प्राप्त नहीं कराई गई। केंद्रीय जन सूचना अधिकारी द्वारा दी गई सूचना, दिनांक 30.4.2024 की प्रति, प्रथम अपील के आर्डर के साथ संलग्न की जा रही है। NA
635 CICOM/A/E/24/00126 Ms. ROOP AVTAR KAUR 20-04-2024 Ref RTI No. - CICOM/R/E/24/00311 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that "DEAR SIR, I have not received any response in the mentioned application. I kindly request you to provide me with the requested information." DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. In the instant case, the CPIO has replied to the RTI application on 27.03.2024. As per Section 2(f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collate information that is not a part of the record. The information once published in public domain may not be treated as information held by a particular public authority. The information sought in the RTI is available in public domain on the CIC website. Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act,2005. Hence, no intervention is required on behalf of the FAA in this matter. The appeal is disposed of accordingly. NA
636 CICOM/A/E/24/00125 Brig. VIPIN CHAKRAWARTI 20-04-2024 The First Appeal, RTI application and reply given by CPIO is CIC have been perused. As per section 8(1) (j) information which relates to personal information the disclosure of which has no relationship to any public activity of interest, or which would cause unwarranted invasion of the privacy of the individual may be exempted from disclosure unless the Central Public Information Officer of the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information. Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act, 2005. Hence, no intervention is required on behalf of the FAA in this matter. The appeal is disposed of accordingly. NA
