Please provide a list of official cars indicating which ministry/department has provided which official car to its officers of the rank of Joint Secretary, Additional Secretary and Secretary. Please specify the name of car also. Shri S.K. Rabbani, CPIO & DS(GA) vide reply dated 26.06.18 has stated that “The information sought is not clear and specific.” In the appeal, appellant has stated that “The reply provided to my RTI application is avoided on the ground that the question is not clear and specific, whereas I specifically asked for the name of the car provided officially to the officers of Joint Secretary, Additional Secretary and Secretary rank for example Maruti Ciaz is given to an officer of Additional Secretary level of Government of India. Please provide the specific information in listed form as to which car/official vehicle is provided to the officers of Joint Secretary, Additional Secretary and Secretary rank in various ministries of Government of India.” From perusal of RTI application and submission made in the first appeal, it appears that appellant wants to know name of the cars included in the staff car list and a list of official car provided by Ministries/Department to its officers of Joint Secretary, Additional Secretary and Secretary. As far as list of cars included as staff car is concerned, this information may be available with Department of Expenditure, Ministry of Finance. Direction is accordingly given to Shri S.K. Rabbani, CPIO & DS(GA) to transfer the RTI application u/s 6(3) of the RTI Act to the Department of Expenditure, Ministry of Finance with a copy to the appellant within 5 days from the date of receipt of the order. The list of official cars provided to Joint Secretary, Additional Secretary and Secretary of the Ministries/Departments is not maintained at this office, therefore, appellant is advised to approach the concerned Ministry/Department to get the information. 1153 CICOM/A/2018/60080 AJITKUMAR VASANTRAO SONTAKKE 23-06-2018 On perusal of the RTI application, reply of the CPIO and appeal, it is observed that the appellant is aggrieved with the non-compliance of the Commission’s decision No.CIC/DSSSB/A/2017/608427 dated 20.03.2018 and the appellant brought to the notice of the CIC regarding the non-compliance of the orders of the IC(YA) on 22.05.2018 vide Diary No.132167. No action apparently has been taken on his petition/request regarding non-compliance. Instead of providing information regarding action taken on his non-compliance petition, Shri R.P. Grover, CPIO has transferred his RTI application u/s 6(3) to the respondent authority i.e. DSSSB, New Delhi, which shows that CPIO has not gone through the RTI application properly. In the appeal, appellant has stated that action should be taken by CIC for the non compliance of order by the DSSSB. Shri R.P. Grover, CPIO & DO to IC(YA) is accordingly directed to provide action taken on the non-compliance filed vide Dy.No.132167 dated 22.05.2018 to the appellant within 2 weeks from the date of receipt of the order. 1158 CICOM/A/2018/60079 AJITKUMAR VASANTRAO SONTAKKE 19-06-2018 In the appeal, appellant has requested for audio-conferencing over his mobile No.9560901490. Accordingly, the appellant was contacted on 20.06.2018 at 1100 hrs. The appellant has stated during the hearing that he aggrieved with the reply of CPIO on Point-5 of the RTI application as the CPIO has not provided the reasons for taking back ministries/departments from Hon’ble Information Commissioner, Shri M. Sridhar Acharyulu. Shri Jeewan Chandra, CPIO was called with requisite papers. On perusal of the requisite papers and information provided, it is observed that there is no “taking back Ministry/Department from the said Hon’ble Information Commissioner”. In fact, it is the work distribution done by the Commission from time to time. There is no reason available on the file. The Ministry/Department allotted from time to time related information has already been provided by the CPIO. Shri Jeewan Chandra, CPIO(MR) has exceeded to his authority in writing such factually not correct information that “As per RTI Act, the reason for taking back Ministries/Department may not be provided”. Shri Jeewan Chandra, CPIO (MR) is hereby ‘WARNED’ to be careful in dealing with the RTI application and ensure that only relevant information be furnished, in future. NA
1159 CICOM/A/2018/60078 AJITKUMAR VASANTRAO SONTAKKE 15-06-2018 In the RTI application, appellant has sought following information in respect of case File No.CIC/MP/A/2014/000332:- “a. Pl provide a copy of the intimation by NCW to CIC in compliance with direction of Fact Finding Committee per para no.7.8 of its report. b. If no intimation is received, please provide copy of letter sent by CIC to NCW since receipt of Fact Finding Report in October 2016. c. Information and supporting documents as regards action taken by CIC for non-compliance of the affidavit given by NCW to CIC in July 2015 that it will take disciplinary action on receipt of the case files.” Shri T.K. Mohapatra, CPIO & DO to IC(SA) has replied as under:- “…. Point a,b and c: The concerned case file which is available in the digitized form in the AppsCom of this Commission consists of 361 pages. It is not possible to identify and segregate the documents required by you from the voluminous documents. You may inspect the file and identify the document(s) as per your requiredment so that the copy fo the same can be provided or you may take copy of the whole file by depositing Rs.722/- @ Rs.2/- per page by Demand Draft, Postal Order or Bankers Cheque in favour of Pay and Account Officer, CAT payable at New Delhi.” Since appellant resides in Mumbai, therefore, she stated in the appeal that she is not in Delhi to take physical inspection and requested to direct the CPIO to upload the digitized 361 pages for online verification or send her the soft copy to identify the documents which she need and can apply per requisite fees to obtain certified copies. In case, this is not possible, then at the least to provide her the index of 361 pages showing the date of submission, name of party which submitted, no. of pages and title of the submission. In this regard, Shri T.K. Mohapatra, CPIO cum DO to IC(SA) has been called for and discussed the matter. Shri Mohapatra agreed to provide copy of complete case file to the appellant. Direction is accordingly given to Shri T.K. Mohapatra, CPIO cum DO to IC(SA) to provide copy of complete documents of digitized case File No.CIC/MP/A/2014/000332 to the appellant within 10 days from the date of receipt of the order. NA
