I had previously filed three RTI requests dated 29/08/2022, 26/12/2022 and 30/12/2022 seeking clarification on certain allegations, but unfortunately, I did not receive any clear answers from the CIC officers. I strongly believe that Mr. Anuj Upadhyay is able to carry out his activities successfully due to the support of other officers in the organization. The lack of transparency and clear answers regarding the allegations has led to a great deal of confusion and frustration. Therefore, I am requesting an immediate review of my RTI requests and a thorough investigation into the matter. I am confident that the CIC will take this matter seriously and take the necessary steps to ensure that the RTI Act 2005 is being followed appropriately. I request that my appeal be considered urgently and that I be provided with a response at the earliest possible time. Thank you for your attention to this matter.” DECISION OF THE FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. In the instant case, the Appellant has submitted the first appeal after 30 days of receipt of reply of the CPIO i.e. reply dated 01.11.2022, which is well beyond 30 days. Appellant has not specified anything which could be taken as sufficient cause for the appellant not filing the appeal in time. So, this appeal cannot be taken into consideration as the time limit for submission of first appeal has already exceeded. The appeal is not admitted as per Subsection (1) of Section 19 of the RTI Act, 2005. The appeal is disposed of accordingly. NA

1284 CICOM/A/P/23/00045 Ms. ROOP AVTAR KAUR 17-03-2023 Ref RTI No.- CICOM/R/P/23/00035 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal being aggrieved with the decision of PIO and the appellant also mentions that the desired information is necessary to trace out the missing amount of about Rs. 4 lakh. DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. As per Section 2(f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. 1285 CICOM/A/E/23/00098 Ms. ROOP AVTAR KAUR 17-03-2023 Ref RTI No.- :CICOM/R/E/23/00005 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that Prayers: This Hon. Appellate Authority may be pleased to: 1) condone this delayed submission for reasons described below and admit this appeal and inquire into the matters raised herein, and 2) direct the CPIO to furnish all the information free of cost, and Grounds: 1) The instant RTI application was received by the CPIO of this public authority on 02/01/2023. Subsequently it was transferred to another CPIO of this public authority on 05/01/2023. According to Section 7(1) of the RTI Act, the second CPIO ought to have responded to the instant RTI application within a period of 30 days. That deadline lapsed on 05/02/2023. After waiting for a further period of 15 days, this Appellant telephoned the second CPIO of this public authority to remind him about the pendency of the instant RTI application. The said CPIO explained to this Appellant about certain tragic circumstances with which he had to deal on the family front as the cause for this delay. So this Appellant elected to wait for a reply until today out of basic human courtesy towards the said CPIO. But as of today, the status of action taken on the instant RTI application continues to be displayed on the RTI Online Facility as: REQUEST TRANSFERRED TO ANOTHER CPIO. This Appellant is no longer willing to wait for a reply from the said CPIO. The delayed submission of this appeal may please be condoned for the reasons explained above. 2) When a CPIO fails to give a decision within the stipulated deadline, a citizen may submit an appeal under Section 19(1) of the RTI Act, against such lack of response. 3) Further according to Section 7(2) of the RTI Act, where a CPIO fails to give a decision on an RTI application, it shall be deemed that he has refused access to information. Such deemed refusal is also a ground for submitting an appeal under Section 19(1) of the RTI Act by an aggrieved citizen. 4) Further, according to Section 7(1) of the RTI Act a CPIO has only two options for disposing an RTI application. He may either disclose the requested information on payment of additional fees or reject the request wholly or partially for reasons specified under Sections 8 or 9 of the RTI Act. The CPIO of this public authority has not performed either action within the statutory deadline of 30 days. According to the scheme of the RTI Act explained above, it is not open for a CPIO to sit quietly on an RTI application without communicating a decision to the RTI applicant. 5) Further according to Section 7(6) of the RTI Act, where a CPIO fails to furnish the requested information within the stipulated time limit, the RTI applicant is entitled to receive it free of charge. Hence the submission of this appeal to this Hon. Appellate Authority. DECISION OF THE FIRST APPELLATE AUTHORITY: The First Appeal and the RTI application have been perused.
