1342 CICOM/A/P/23/00017 Ms. ROOP AVTAR KAUR 16-02-2023 Ref RTI No.- CICOM/R/P/22/00703 GROUNDS FOR FIRST APPEAL: The Appellant submitted the first appeal stating that “...From the information provided in the matter and the facts narrated above, it is evident that the acts of the PA to the FAA, in not making noting, not putting up the review application dated 11.07.22 to the FAA and linking it with so called First appeal no. CICOM/A/P/22/ 00071, whereas the application dated 16.05.2022 which is described and dealt with as first appeal is in fact not a first appeal but instead it is an application wherein a request is made for putting the relevant proceedings before the Hon’ble Chief Information Commissioner for the reasons submitted therein as also mentioned above and has given rise to the submission of the aforesaid review application, which consequently requires consideration and decision of the FAA as per law to avert miscarriage of justice and abuse of power, are illegitimate and unlawful....” DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. The opportunity of written submission, for the first appeal, provided to the appellant is found to be reasonable opportunity of hearing. The written submissions made by the appellant in his first appeal application are found to be sufficient for consideration by the FAA to arrive at a decision under the RTI Act, 2005. Accordingly, it was felt that the personal hearing as requested by appellant was not necessary. 1343 CICOM/A/E/23/00064 Ms. ROOP AVTAR KAUR 13-02-2023 Ref RTI No.- CICOM/R/E/22/01009 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that “Reasons to appeal – negligence and carelessness in giving records to me by acpio cpio of ministry and deemed pio’s.” DECISION OF THE FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. In the instant case, the Appellant has submitted the first appeal after 30 days of receipt of reply of the CPIO i.e. reply dated 09.11.2022. The First Appeal has been initiated by the appellant on 13.02.2023 which is well beyond 30 days. Appellant has not specified anything which could be taken as sufficient cause for the appellant not filing the appeal in time.
