GROUNDS FOR FIRST APPEAL:
The Appellant submitted first appeal stating that:
“I am not satisfied at all from the information given by the pio to me I have asked specifically the questions which pertains to cic and their valid authorization and power under which they have issued stay order Specifically I need aswer either cic has power to issue stay order yes or no If cic has authority to issue stay order kindly quote me the act because under rti act cic has no such power to issue stay order or interim stay order. If any information commissioner gives arbitary decision where we can complaint either to chief information commissioner or any body exist thereâ€

1. Decision of CIC dated 24-02-2020 was not implemented by Sh. R.P. Grover, Dy. Registrar of CIC, vide his office order No. CICOM/R/P/21/00098 dated 07-03-2022. Therefore, Sh. R.P. Grover, Dy. Registrar of CIC, should be punished u/s 20(1) of RTI Act 2005 and provide the correct information to the applicant as sought in RTI application dated 24-01-2018. Copy enclosed.
2. Award dated 28-10-1995 was not implemented by Sh. V.K. Rao, Labour Officer, Govt. of NCT of Delhi vide his office order no. 8(15)/RTI/SPIO/SD/19/6563 dated 6-3-2019 and by Shri R. P. Grover, Dy. Registrar of CIC vide his office order dated 7-3-2022. Therefore, implement the award dated 28-10-1995 and pay the salary arrear Rs. 68,34,915/- to the applicant under CCS Rule of the Govt. of India, 1972 and for compliance the award dated 28-10-1995 within 10 days from received of this appeal. All the documents are enclosed. Please consider.

GROUNDS FOR FIRST APPEAL:
The Appellant in the first appeal application has mentioned following point-wise grounds:
For Part I - An affidavit to the Commission regarding the factual position of the availability of information by 31-8-2021 failing which the Commission may initiate penal action as per section 20(1) of the RTI Act, 2005. Copy of Commission’s Order will result in penalty. Kindly provide me attested copy of penal action initiated against the D. C. Jammu. More than 5 years have already lapsed.
Part II & III - Kindly intimate me the action taken and present status of second appeal dated 31-12-2021 as per records on file because the Commission’s website is not fully updated so providing incomplete information.
Part IV - Complete information received.
Part V - This 5th part of my RTI application form dated 31.12.2021 is omitted by all the above mentioned CPIOs. Kindly provide me attested copies of action taken and present status of my second appeal submitted to the CIC, New Delhi on 25-8-2021.

The Appellant in the first appeal application has prayed as follows:
A) Immediately provide the true, correct, complete and accurate information of Query 4A to B to the appellant.
B) Provide the information of Query 4A & B free of cost as per section 7(6) of RTI Act to the appellant.
C) Issue a Circular/Order directing PIOs of CIC to mentioning the Official Mobile Number or Contact Number and E. Mail ID in replies/decisions in future correspondence in compliance to the OFFICE MEMORANDUM No. 10/01/2013-IR dated 06.10.2015 of DOPT, Govt. of India.
D) Provide a token compensation of Rs. 200/- for the mental pain, agony, unnecessary financially loss and determent suffered to the appellant.
E) Pass any other such further orders be also passed that this First Appellant Authority may deem fit and proper in the facts and circumstances of appeal in favour of appellant and against the PIO/Respondent in the interest of justice, equity and good conscience.
F) The appellant has also submitted an application for granting of hearing and issue of hearing notice to parties.

As per DoPT guidelines, it is not mandatory that FAA may conduct a physical hearing. The opportunity of written submission provided to the appellant is reasonable opportunity of hearing. The written submissions made by the appellant in his first appeal application are found to be sufficient for consideration by the FAA to arrive at a decision. Accordingly, it was felt that the personal hearing as requested by appellant was not necessary.
Though the copy of file (electronic copy) is already provided by the CPIO(Admin Section) to the appellant which was requested by the appellant in Point 4A. CPIO(Admin Section) is directed to revisit the RTI application for Point 4B and provide opportunity for inspection of records on the day mutually agreed by the CPIO & Appellant, free of cost.
