983 CICOM/A/E/23/00332 Ms. ROOP AVTAR KAUR 31-08-2023 Ref RTI No.- CICOM/R/E/23/00883 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that it is submitted that the CPIO has not provided the information on technical grounds that no such information is available about the role and responsibility of the above persons at the time of issue of final order. It may not be out of place to mention here that the duties and responsibilities of persons who are working in any organization remain same at all the time when they are working in any organization. In other words, my RTI application dated 2.8.2023 mainly relate to role and duties of above persons as indicated in point No. 2(i) to (iii) in my RTI application dated 2.8.2023. -2- 4. Ref:- CICOM/R/E/23/00908 7 00910 1) The request for details of dealings/orders in the file has been turned down under section 8.1(j) of the Act, as is usually done by CPIOs to avoid supply of information and it is not appealed against. 2) It is a fact that the Appellant in this case and the Applicant for information are one and the same firm and hence the reason of personal information of Appellant available in the file can hardly be appreciated. 986 CICOM/A/E/23/00329 Ms. ROOP AVTAR KAUR 30-08-2023 Ref RTI No.- CICOM/R/E/23/00808 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that REPLY FROM THE CHIEF INFORMATION COMMISSION OFFICE The reply is given by letter F.NO. 2023/CIC/ADMN/RTI Dated 14.08.2023 which is signed by Consultant SO (Admn) & CPIO. (Copy enclosed). The reply is as under “ The decision given by the Commission being quasi-judicial act, as such , it can neither be commented nor can it be reviewed. Aggrieved party may like to approach appropriate forum for redressal of his grievance, if any” IS ABOVE REPLY CORRECT ? No above reply is not correct. It shows lack of legal knowledge. The reply overlooks at the power of Supreintendence enumerated in Section 12(4) and the responsibilities as per Section 14 of the Right to Information Act – 2005. It may be seen that the Chief Information Commissioner’s duty is to examine the orders of the Information Commissioner and as per power of Superintendence vested in him he is supposed to recommend action to the President of India or the Supreme Court as per Section 14 of the RTI Act- 2005. Not doing so will mean that the Chief Information Commissioner is screening the offender which is criminal offence as per Section 202 of the Indian Penal Code. It is hereby repeated that every citizen has been given by the power of prosecution as per Section 190( c ) of the Criminal Procedure Code 1908 (Act 2 0f 1974). Only pre-requisite is that the citizen has to take permission from the appropriate authority as per Section 197 of the Cr.P.C. I have made application to the president of Indian and President of India has forwarded it to CIC office. Now CIC office has to send a report to the President of India. I have asked for the details/copies of note sheets and extract of file details of the processing of this application. Not giving me the information is also criminal offence as per Sections 166,167,202,217,218,219,406,409,415,418 and 420 of Indian Penal Code 1860. PRAYERS 1) I may be given the information I have requested for. That is details of handling my application for prosecution of Smt. Saroj Punhani. The copies of the Note sheets and action taken at the CIC office. If information is not given or misleading information is given I will be compelled to make application for prosecution of Chief Information Commissioner and CPIO as per Section 190 Cr.P.C read with Section 197 of Cr.P.C. CICOM/R/T/23/00062 में सूचना मांगी थी जिसके प्रतिउत्तर में केंद्रीय जन सूचना अधिकारी द्वारा प्रेषित की गई सूचना, सूचना का अधिकार अधिनियम के प्रावधानों एवं मांगी गई सूचना के अनुसार ही है। अतः सूचना के अधिकार अधिनियम की धारा 2 (च) के प्रावधानों के अनुसार एक जन सूचना अधिकारी केवल सम्बंधित लोक प्राधिकरण के रिकॉर्ड में एक सामग्री के रूप में उपलब्ध सूचना ही प्रदान कर सकता है। अतः केंद्रीय जन सूचना अधिकारी द्वारा प्रदान की गई सूचना तथ्यात्मक है और इसमें प्रथम अपीलीय अधिकारी के हस्तक्षेप की कोई आवश्यकता नहीं है। NA
