this RTI application has been part-transferred to the undersigned CPIO for replying to points 5, 7, 8 & 9. Point-wise reply of this CPIO on these points is as follows:
5.A) There is no fixed period as such to decide a non-compliance case. However, as far as possible these are taken up in their chronological seniority and availability of inputs from parties etc., so as to enable the Commission to take a decision on the compliance.
5.B) There is no such information. However, if the Commission satisfies with the compliance of its orders on the basis of records (from both parties) available with it, no further hearings are held and non-compliance case is disposed without hearing.
5.C) There are no such reasons available as per the records of the Commission. However, in clear cases of compliance by the respondent, hearings are not held.
5.D) Your attention is drawn to RTI Act, Rules, guidelines, FAQs available on the website of the Commission, cic.gov.in. There is no appeal/review of cases. Same law applies to all cases including non-compliance cases and there are no separate provisions for non-compliance cases.

In reference to your RTI application No. CICOM/R/E/21/00659/3, transferred to the registry of IC(VN) on 14/07/2021. The point wise information is furnished as under:
Point No. 3-The PDF Files of File No. CIC/MOCAF/A/2019/643355 & CIC/MOCAF/A/2019/640247 mentioned by you in the RTI application have been sent to you at your E-mail id - snehcs5@gmail.com on 10/08/2022 (A copy of the sent email is attached). However, File No. CIC/MOCAF/A/2019/640529 mentioned by you in your RTI application is not available in the appscom system of the Commission.
Point No. 5-A. There is no prescribed time limit to decide Non-compliance cases.
B. No. However, in case the Non-compliance case is enlisted for hearing, the complainant/appellant is also issued notice to attend the hearing to submit his/her statement or rebut the submission, made by the respondent.
C. The information sought is clarificatory in nature as such, does not fall within the definition of information as per Section 2(f) of the RTI Act 2005.
