1713 CICOM/A/E/22/00139 Ms. ROOP AVTAR KAUR 11-05-2022 Ref RTI No.- CICOM/R/E/22/00412 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that: Ground of Appeal If cic did not had any information that it does not preatains to same issue with refrence to company Gradiente infotainment Ltd and RTA karvy computer shares pvt then how dated 23 Dec 2021 it was disposed by cic not on Record and same issue and DECISION OF THE FIRST APPELLATE AUTHORITY: The First Appeal petition, RTI application and reply given by CPIO of CIC have been perused. As per Section 2(f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collect information that is not a part of the record. In the instant case, the CPIO has also offered inspection of records on a mutually agreed time and date and the grounds of appeal mentioned are beyond the mandate of the First Appellate Authority. 1714 CICOM/A/E/22/00135 Ms. ROOP AVTAR KAUR 11-05-2022 Ref RTI No.- CICOM/R/E/22/00225 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that: In view of the aforementioned facts and circumstances, the Ld. First Appellate Authority may be pleased to: (a) Provide certified copies of information sought, free of costs as required u/s 7(6) of the Right to Information Act, 2005; and; (b) Pass other or further orders as may be deemed fit and proper. DECISION OF THE FIRST APPELLATE AUTHORITY: The First Appeal petition, RTI application and reply given by CPIO of CIC have been perused. The opportunity of written submission provided to the appellant is found to be reasonable opportunity of hearing. The written submissions made by the appellant in his first appeal application are found to be sufficient for consideration by the FAA to arrive at a decision under the RTI Act, 2005. Accordingly, it was felt that the personal hearing as requested by appellant was not necessary. In the instant case, the Appellant has submitted the first appeal after 30 days of receipt of the reply from the CPIO i.e. reply dated 04.04.2022. The First Appeal has been initiated by the appellant on 11.05.2022, which is well beyond 30 days. Appellant has not specified anything which could be taken as sufficient cause for the appellant not filing the appeal in time. So, this appeal cannot be taken into consideration as the time limit for submission of first appeal has already exceeded. The appeal is not admitted as per Subsection (1) of Section 19 of the RTI Act, 2005. The appeal is disposed of accordingly. NA
1715 CICOM/A/E/22/00136 Ms. ROOP AVTAR KAUR 11-05-2022 Ref RTI No.- CICOM/R/E/22/00279 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that: Where the reply states that the CIC does not have information on unlawful acts and fraud by CIC or its employees where such fraud is perpetrated to pepetuate fraud and is also associated with wilful disregard of its duties and also furnishing false reports to Parliament and also aiding and abetting Ministry corporate Affairs and ICAI and others aiding and abetting fraudsters by not acting against them and thus flout orders under RTIA and CIC does not act and in addition the impact of this wilful inaction by CIC has been avoidable losses on avoidable transactions of not less that trillions and quadrillions of Rs has been faced by people of India and the losses being attributable to refusal to ensure that auditors report perverse and adverse matters under MAOCARO and CARO and Sec 227 3 e and 227 1A a of Companies Act 1956 and Sec 143 3 f and sec 143 1 a of Companies act 2013 and Board of Directors comply with Sec 217 1 a Sec 217 1 d Sec 217 3 and 217 2AA of Companies Act 1956 and Sec 134 3 f and 134 3 i 134 3 l 134 5 etc etc Companies act 2013 and CIC flouts and does not discharge its duties under Sec 18 and other provisions of RTIA the CPIO has of course withheld information fraudulently . This has been done knowingly and wilfully to make things difficult to the applicant to evidence role of CIC in fraud on people of India explained in attachment being first appeal in CICOMAE2200136 CICOMRE2200279. It is impossible that CIC does not have details of persons responsible for the fraud on people of India perpetrated by ensuring that fraud is perpetrated on people of India and in such cases action must be initiated against all including all in M and R Section and all in all the sections dealing with the second appeals and non compliances and related matters and key personnel in CIC . Names and designations of all such persons . The CIC is itself wilfulyy flouting the very law being the law for the implementation of whihc CIC was incorporated DECISION OF THE FIRST APPELLATE AUTHORITY: The First Appeal petition, RTI application and reply given by CPIO of CIC have been perused. 1718 CICOM/A/P/22/00063 AJITKUMAR VASANTRAO SONTAKKE 06-05-2022 प्रथम अपील का आधार अपीलकर्ता ने दिनांक 30/03/2022 को जन सूचना अधिकारी से 2 बिंदुओं पर सूचना मांगी थी। बिंदु संख्या 1 व 2 में सूचना उपलब्ध नहीं होने की बात की गई है। निर्णय आर. टी. आई. आवेदन, प्रदान की गई सूचना एवं प्रथम अपील का अवलोकन करने पर पाया गया कि अपीलकर्ता के आर.टी.आई. आवेदन सं. CICOM/R/P/22/00157 के प्रतिउत्तर में केंद्रीय जन सूचना अधिकारी द्वारा प्रेषित की गई सूचना, सूचना का अधिकार अधिनियम के प्रावधानों एवं मांगी गई सूचना के अनुसार ही है। उल्लेखनीय है कि सूचना अधिकार का अधिनियम की धारा 2 (च) के प्रावधानों के अनुसार एक जन सूचना अधिकारी केवल सम्बंधित लोक प्राधिकरण के रिकॉर्ड में एक सामग्री के रूप में उपलब्ध सूचना ही प्रदान कर सकता है। अतः केंद्रीय जन सूचना अधिकारी द्वारा प्रदान की गई सूचना तथ्यात्मक है और इसमें प्रथम अपीलीय अधिकारी के हस्तक्षेप की कोई आवश्यकता नहीं है। तद्नुसार अपील निस्‍तारित की जाती है। NA
1719 CICOM/A/P/22/00064 AJITKUMAR VASANTRAO SONTAKKE 06-05-2022 Ref RTI No.- CICOM/R/P/22/00106 GROUNDS FOR FIRST APPEAL: The Appellant in the first appeal states that no reply is received despite expiry of statutory time limit for disposal of the RTI application but the appellant has received a reply from CPIO M&R section to a fictitious RTI application dated 03.03.2022(not filed by appellant) in which the CPIO has dated the RTI application as 03.03.2022 and reply dated 14.03.2022. The appellant requests the FAA for supply of correct and complete information to the RTI dated 21.02.2022 by registered post. DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal petition, RTI application and CPIO’s reply have been perused. The CPIO of CIC have provided information as per the records of the Commission As per Section 2(f) of RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collect information that is not a part of the record. In the instant case, the reply furnished by the CPIO M&R Section is to the RTI application dated 21.02.2022 (filed by the appellant) but the CPIO has mentioned the date of receipt of RTI application in Central Information Commission i.e. 03.03.2022 as date of RTI application and the RTI application was transferred on 14.03.2022 from CPIO Dak Section to CPIO M&R Section. CPIO M&R Section is directed to upload the reply with all the attachments on the RTI portal as per DoPT O.M. No. 1/1/2013-IR dated 08.04.2013 in the future. Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act, 2005. Hence, no intervention is required on behalf of the FAA in this matter. 1720 CICOM/A/P/22/00062 Ms. ROOP AVTAR KAUR 06-05-2022 Reference RTI No.CICOM/R/P/22/00028 प्रथम अपील का आधार अपीलकर्ता द्वारा सूचना के अधिकार अधिनियम की धारा 19 (1) के तहत जानकारी हिंदी भाषा में तथा निर्धारित समय-सीमा में उपलब्ध करवाने हेतु प्रथम अपील दायर की गई है। निर्णय संबंधित संचिका (प्रथम अपील आवेदन एवं आर.टी.आई. आवेदन) का अवलोकन करने पर पाया गया कि अपीलकर्ता द्वारा आर टी आई आवेदन दिनांक 11-01-2022 केन्‍द्रीय जन सूचना अधिकारी को प्रेषित किया गया था तथा प्रथम अपील दिनांक 29-04-2022 को दायर किया गया है। सूचना का अधिकार अधिनियम, 2005 की धारा 19 (1) के तहत प्रथम अपील RTI आवेदन दायर करने की तिथि से या सूचना प्राप्ति की तिथि से 30 दिनों के भीतर ही दाखिल किया जाना अपेक्षित है। अपीलकर्ता द्वारा दो माह और 18 दिनों की देरी से प्रथम अपील दाखिल किये जाने का कोई कारण भी नहीं बताया गया है। अतः उक्त तथ्यों के आधार पर प्रथम अपील ख़ारिज की जाती है। तद्नुसार अपील निस्‍तारित की जाती है। NA
