1722 CICOM/A/E/22/00133 Ms. ROOP AVTAR KAUR 04-05-2022 Ref RTI No.- CICOM/R/E/22/00348 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that: To The FAA CIC Sub.first Appeal Please Review& Revisit my RTI Application & Supply information On Query 02 to 06 following Grounds/Relevant judgement. pls comply Below H Delhi High court Verdict JP Agarval Vs UOI para Number 07 Reproduce Section 4 of the Act obliges every public authority to publish inter alia the particulars of facilities available to citizens for obtaining information and the names, designations and other particulars of the PIOs. Section 5 requires the public authorities to designate PIO to provide information to persons requesting for information under the Act. Such PIOs, under Section 5(2) of the Act are to receive applications for information and under Section 5(3) of the Act are to deal with request from persons seeking information and render reasonable assistance to the information seekers. The Act having required the PIOs to Deal with the request for information and to render reasonable assistance to the information seekers, cannot be said to have intended the PIOs to be merely Post Offices as the petitioner would contend. The expression deal with in Karen Lambert Vs. London Borough of Southwark (2003) EWHC 2121 (Admin) was held to include everything right from receipt of the application till the issue of decision thereon. Under Section 6(1) and 7(1) of the RTI Act, it is the PIO to whom the application is submitted and it is he who is responsible for ensuring that the information as sought is provided to the applicant within the statutory requirements of the Act. Section 5(4) is simply to strengthen the authority of the PIO within the department; if the PIO finds a default by those from whom he has sought information, the PIO is expected to recommend a remedial action to be taken. The RTI Act makes the PIO the pivot for enforcing the implementation of the Act. Please in view of principle of Natural justice provide Reasonable opportunity Before Disposal of Appeal Accordingly. DECISION OF THE FIRST APPELLATE AUTHORITY: The First Appeal petition, RTI application and reply given by CPIO of CIC have been perused. As per Section 2(f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collect information that is not a part of the record. The opportunity to make submissions before First Appellate Authority under the RTI Act, 2005 itself is a reasonable opportunity before disposal of the subject appeal. Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act, 2005. Hence, no intervention is required on behalf of the FAA in this matter. Whereas attested copy of the information was wanted by me. Please kindly direct the Public Information Officer to supply the attested copy of the information to the appellant free of cost. 1729 CICOM/A/E/22/00129 Ms. ROOP AVTAR KAUR 30-04-2022 Ref RTI No. CICOM/R/E/22/00297 प्रथम अपील का आधार अपीलकर्ता को केंद्रीय जनसूचना अधिकारी के जवाब से यह नहीं समझ आया कि भारत सरकार के विभागों की वेबसाइट पर आर टी आई सम्बन्धी जानकारी सुगम तौर या फिर खुलती ही नहीं है तो आयोग शिकायतों के अलावा किस तरह से मॉनिटर करवाता है जब अपीलकर्ता ने एल आई सी की वेबसाइट की शिकायत की तब वह नहीं खुल रही थी परन्तु शिकायत के बाद दुरुस्त कर दी गई। निर्णय ऑनलाइन आर. टी. आई. आवेदन, प्रदान की गई सूचना एवं प्रथम अपील का अवलोकन करने पर पाया गया कि अपीलकर्ता के आर.टी.आई. आवेदन सं. CICOM/R/E/22/00297 के प्रतिउत्तर में केंद्रीय जन सूचना अधिकारी (M&R Section) द्वारा प्रेषित की गई सूचना, सूचना का अधिकार अधिनियम के प्रावधानों एवं मांगी गई सूचना के अनुसार ही है। अतः केंद्रीय जन सूचना अधिकारी द्वारा प्रदान की गई सूचना तथ्यात्मक है और इसमें प्रथम अपीलीय अधिकारी के हस्तक्षेप की कोई आवश्यकता नहीं है। हालाँकि विशेष रूप से विस्तृत जानकारी के लिए अपीलकर्ता सूचना का अधिकार अधिनियम 2005 की धारा 18 का अवलोकन कर सकता है। तद्नुसार अपील निस्‍तारित की जाती है। NA
1730 CICOM/A/P/22/00056 Ms. ROOP AVTAR KAUR 29-04-2022 आर.टी.आई. आवेदन, प्रदान कि गई सूचना एवं प्रथम अपील का अवलोकन करने पर पाया गया कि अपीलकर्ता के आर.टी. आई. आवेदन सं CICOM/R/P/22/00101 के प्रतिउत्तर प्रदान की गई सूचना, सूचना का अधिकार अधिनियम, 2005 के प्रावधानों के अनुसार ही है। परन्तु केंद्रीय जन सूचना अधिकारी द्वारा प्रेषित कि गई सूचना ऑनलाइन दी गई है जबकि उसने आर.टी.आई ऑफलाइन की थी। अतः केंद्रीय जन सूचना अधिकारी को यह निर्देश दिए जाता है कि वह अपीलकर्ता को आर.टी.आई. आवेदन सं. CICOM/R/P/22/00101 तहत मांगी गई सूचना का अवलोकन कर 10 दिन के भीतर अपीलकर्ता को पूर्ण एवं स्पष्ट सूचना (फ्री ऑफ कॉस्ट) ऑफलाइन प्रेषित की जाये। अतः केंद्रीय जन सूचना अधिकारी द्वारा प्रदान कि गई सूचना तथ्यात्मक है और इसमें प्रथम अपीलीय अधिकारी के हस्तक्षेप कि कोई आवश्यकता नहीं है I NA
