246 CICOM/A/P/25/00028 Ms. ROOP AVTAR KAUR 16-01-2025 आर. टी. आई. आवेदन, प्रदान की गई सूचना एवं प्रथम अपील का अवलोकन करने पर पाया गया कि अपीलकर्ता ने आर. टी. आई. आवेदन दिनांक 05.10.2024 को किया था जिसके उत्तर में केंद्रीय जन सूचना अधिकारी ने सूचना दिनांक 28.10.2024 को प्रदान की गई थी। सूचना का अधिकार अधिनियम, 2005 के तहत प्रथम आवेदन सूचना की प्राप्ति के 30 दिनों के भीतर ही दाखिल किया जाना अपेक्षित है। अपीलकर्ता द्वारा प्रथम अपील 03.01.2025 को किया गया है, जो 30 दिनों से भी अधिक समय है। अपीलकर्ता द्वारा देर से प्रथम अपील दाखिल किये जाने का कोई कारण भी नहीं बताया गया है। अतः उक्त तथ्यों के आधार पर प्रथम अपील ख़ारिज की जाती है। NA

RTI No. - CICOM/R/P/24/00571 DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. As per Section 2(f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collate information that is not a part of the record. As per the Section 6(1) of the RTI Act, 2005, the applicant shall file information request with the concerned Public Authority which holds the information. In the instant case, the CPIO & DS (RTI Cell) has already replied to the RTI application on 06.01.2025(copy enclosed). The information sought by the applicant in the RTI application pertains to Public Authority of State Government. The Public Authorities of State Government come under the domain of State Information Commission and not under the domain of Central Information Commission. Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act, 2005. Hence, no intervention is required on behalf of the FAA in this matter. The appeal is disposed of accordingly. NA

TOTAL 23 PAGES. GROUNDS FOR APPEAL (a) TYPOs in Dates on document uploaded. And and even dates on the text on PORTAL. (b) The document attached appears to be internal communication as Complete and Correct details of Applicant not given. (c) Badly drafted and scanned document provided. (d) Information for F.Y. 20232024 has not been provided. (e) In my RTI request, I had mentioned that Kindly ensure that my Rank and Name is correctly mentioned as provided below in my address. Once Rank is mentioned the word Shri not required to be mentioned. (f) Submitted."
