GROUNDS FOR FIRST APPEAL:
The Appellant submitted first appeal stating that
"Details of RTI Application: RTI Application No.: CICOM/R/E/24/01642 Date of RTI Submission: [Insert Date] Response Date: 27.12.2024 CPIO Respondent: Suman Bala, CPIO & DS (RTI Cell) --- Grounds for Appeal I am filing this appeal due to the inadequate and evasive response provided by the CPIO to my RTI application. My concerns are as follows: 1. Non-Disclosure of Information Sought: I had requested details of RTI applications filed with Rajasthan Police, specifically those denied under Section 8(1)(h) or other exemptions, along with certified copies of denial reasons. The response stated, "No such information is available on record," which is unsatisfactory. As per Section 4(1)(a) of the RTI Act, public authorities are obligated to maintain proper records. CIC should seek an explanation from Rajasthan Police or direct them to furnish the requested data. 2. Guidelines for Handling Repetitive Reports: I requested certified copies of guidelines or rules issued by CIC to address systemic issues, such as repetitive non-responses. The reply again stated, "No such information is available on record." It is highly unlikely that CIC has not issued any procedural guidelines for handling such issues. If such guidelines do not exist, I request a written explanation for their absence. 3. Escalation of RTI Appeals: I asked for details on appeals filed regarding procedural lapses by Rajasthan Police and the current status of any directives issued by CIC. The response, "Point pertains to CPIO, DR to CR-I and forwarded online on 18.12.2024," does not address my query. I expect a detailed response regarding the number of appeals and directives issued to Rajasthan Police. --- Relief Sought 1. Direct the CPIO to provide a detailed and specific response to all the queries raised in my RTI application, ensuring compliance with Sections 4(1)(a) and 4(1)(d) of the RTI Act. 2. Instruct Rajasthan Police to disclose the requested information or clarify why such records are not maintained. 3. Provide certified copies of any guidelines or rules issued by CIC to address systemic procedural lapses. 4. Provide updates on the status of appeals and directives issued to Rajasthan Police or other state agencie"
DECISION OF FIRST APPELLATE AUTHORITY:
The First Appeal, RTI application and reply given by CPIO of CIC have been perused.
The information sought by the applicant in the RTI application appears to be related to the State Government. The applicant may approach the concerned Public Authority in State Government. Further, the working of State Public Authorities comes under the domain of State Information Commission and not come under the domain of the Central Information Commission.
Hence, no intervention is required on behalf of the FAA in this matter.
The appeal is disposed of accordingly. |

As per Section 2 (f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collate information that is not a part of the record.
Accordingly, the reply given by the CPIO is appropriate and as per provisions of the RTI Act, 2005. Hence, no intervention is required on behalf of the FAA in this matter. |
