In the instant case, CPIO (RTI Cell) is directed to reply to the RTI application and provide information as per available records, as per the provisions of the RTI Act, 2005 by 02.01.2025. 314 CICOM/A/E/24/00373 Ms. ROOP AVTAR KAUR 02-12-2024 Ref RTI No. - CICOM/R/E/24/01518 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that "Sir, i had three major concerns but the case has been closed without addressing the issues raised. The three mainconcerns raised were 1. What is the current status of this joining, any recent update related to this recruitment, chancesof getting my joining letter in upcoming days. 2. I have submitted my original documents during the medical cumdocument verification at ANMCH Gaya in October 2019. If the verification formalities has been completed, how can I getmy documents back. Give me the details of the office for the same. 3. Reasons to delay in the joining, as the panel ofshortlisted candidates were out two years earlier. Additionally, The case has been closed on by making a reference ofthe letter addressed to the collectorate office Gaya to coordinate with principal of ANMCH Gaya regarding return of mysubmitted original documents. Sir, I have followed up the case and chased up collectorate office Gaya several times but Ihavent been entertained at all. And as far as the query related to my documents and ANMCH Gaya is concerned, theyhave strictly refused to accept that my documents have been submitted in the college. After not getting any postingresponse from either end, I raised my concern on this portal, but the case has been closed without taking satisfactory action. Sir, I have tried a lot in the state to get reply by doing RTI, there is only offline option, there is no online option, there is no Bihar Government RTI application, still applied offline by speed post but no reply came." DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. As per Section 2(f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collate information that is not a part of the record. As per the Section 6(1) of the RTI Act, 2005, the applicant shall file information request with the concerned Public Authority which holds the information. The information sought by the applicant in the RTI application appears to be related to the State Government. The applicant may approach the concerned Public Authority in State Government. Further, the working of State Information Commissions does not come under the domain of the Central Information Commission. Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act,2005. Hence, no intervention is required on behalf of the FAA in this matter. The appeal is disposed of accordingly. NA

Being dissatisfied with the same. Therefore, I filed a first appeal before the Commission on the ground that information sought has not been provided to me and requested to direct the respondent to provide complete and correct information." DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. The information sought is very much within the domain of the CIC and if the decisions of the CIC are not available with the CIC itself it will not be available with any other authority. Accordingly the information should be provided in the requisite format as has been sought and not merely stating the link to the website of the CIC" DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused.
