GROUNDS FOR FIRST APPEAL:
The Appellant submitted first appeal stating that:
“Respected Sir, The reply I have received from CPIO Sir does not seem correct, so I want to file a first appeal. I or my colleague will be available in the first appeal. I request to hear the first appeal on video conference or mobile. I will be available on video conference or mobile phoneâ€
DECISION OF FIRST APPELLATE AUTHORITY:
The First Appeal, RTI application and reply given by CPIO of CIC have been perused.
In the instant appeal, the appellant had requested for personal hearing of the first appeal via video conferencing mode to which a hearing was scheduled on 06.12.2024 at 12:00 noon via Bharat VC conference. Both the appellant and the CPIO were present in the hearing via VC mode. All the submissions made by the appellant were considered during the decision on the first appeal.
For Point 1 to 5
As per Section 2(f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create, collate or interpret information that is not a part of the record.
Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act, 2005. Hence, no intervention is required on behalf of the FAA in this matter.
For Point 6 & 7
In the instant case, CPIO(RTI Cell) is directed to revisit the RTI application and provide information to the appellant for point 6 & 7 as per the provisions of the RTI Act, 2005, by 16.12.2024.
The appeal is disposed of accordingly. |

The First Appeal, RTI application and reply given by CPIO is CIC have been perused.
As per section 8(1) (j) information which relates to personal information the disclosure of which has no relationship to any public activity of interest, or which would cause unwarranted invasion of the privacy of the individual may be exempted from disclosure unless the Central Public Information Officer of the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information.
Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act, 2005. Hence, no intervention is required on behalf of the FAA in this matter.
The appeal is disposed of accordingly. |
