On perusal of the RTI application, CPIOs reply and submissions made in the appeal, it is observed that the appellant has not sought any information but made queries in the RTI application. Shri Krishan Avtar Talwar, CPIO cum DR to CR-I in his reply dated 04.07.2019 has addressed all three queries raised, therefore, no further intervention is required on the part of the FAA, in the matter. |

After perusing the RTI application, CPIO’s reply and appeal, Shri Krishan Avtar Talwar has been called for who informed that Facilitation Memo was already generated by the system before receipt of email of the appellant and Facilitation Memo was issued on the basis of instructions contained in the Commission’s Office Order No.CIC/CR-1/2017/0007(pt.2) dated 14.06.2018 and accordingly reply of the RTI application was furnished. Since the above said office order dated 14.06.2018 has now been withdrawn vide Commission’s Office Order No.CIC/4/2016-Rgr dated 27.05.2019, the online complaint u/s 18 of the applicant can be registered. Direction is, therefore, given to Shri Krishan Avtar Talwar, CPIO & DR to CR-I to reconsider the registration of complaint as per the provision of the RTI Act and inform the appellant accordingly. |

FAA is agreed with the plea of the appellant that if the information does not comes under purview of CIC they can send it to concerned department. Accordingly, direction is given to Shri T.B.J.S. Rajappa, CPIO, RTI Cell to transfer Points 1 to 8 of the RTI application to the concerned public authorities u/s 6(3) of the RTI Act.
Further, there is no infirmity in the reply of CPIO, RTI Cell given on Points 9 to 12 of the RTI application, therefore, no intervention is required on the part of the FAA, on these points. |
