GROUNDS FOR FIRST APPEAL:
The Appellant submitted first appeal stating that
"CPIO HAS PROVIDED ME MISLEADING INFORMATION AGAINST POINT NUMBER 1 OF MY RTI APPLICATION AND DENIED ME INFORMATION MENTIONED AT POINT NUMBER 2 AND 3 OF MY RTI APPLICATION AND VIOLATED SECTION 7 OF RTI ACT 2005. THAT HE HAS ALSO COMMITTED GROSS MISCONDUCT AND ABUSE OF POWER WORKING AS PUBLIC SERVANT IN PUBLIC AUTHORITY OF CIC. THAT CIC IS CUSTODIAN OF RTI ACT 2005 IN THISENTIRE NATION AND ITS CPIO IS PROTECTING WRONGDOER CPIO OF EVERY PUBLIC AUTHORITY WHO VIOLATES RTI ACT 2005 BY DENYING OR PROVIDING MISLEADING AND INCORRECT INFORMATION TO THE IINFORMANT . THAT CPIO HAS PROVIDED ME INFORMATION THAT CIC IS PUBLIC AUTHORITY AND IT NOMINATES CPIO AND FAA ALSO BUT HE DENIED ME INFORMATION WHETHER CIC NOMINATES PUBLIC SERVANT WORKING IN CIC ONLY AS CPIO AND FAA OR NOT . THAT HE HAS DENIED ME INFORMATION THAT PUBLIC LIKE ME WHO IS NOT A PUBLIC SERVANT OF ANY PUBLIC AUTHORITY CAN BE NOMINATED BY CIC AS CPIO AND FAA OR NOT . THAT I AM ENCLOSING DEFINITION SECTION OF BHARTIYA NYAY SANHITA 2023 WHICH HAS DEFINED PUBLIC SERVANT AND I HAVE ALSO ENCLOSED INFORMATION REGARDING SECTION 196 AND 197 AND 199 OF BHARTIYA NYAY SANHITA 2023 FOR READY REFERENCE FOR FAA SIR WHO IS ALSO A PUBLIC SERVANT IN THE PUBLIC AUTHORITY OF CIC. DENYING INFORMATION TO ME BY THE ERRING CPIO IS EVIDENT THAT PUBLIC AUTHORITY OF CIC IS INTENTIONALLY DENYING ME THE INFORMATION AND VIOLATING SECTION 4 OF RTI ACT 2005 MALICIOUSLY TO PROTECT ALL WRONG DOER CPIO AS WELL AS FAA WORKING IN ANY PUBLIC AUTHORITY FROM CRIMINAL PROSECUTION IN THIS NATION. CPIO SHALL HAVE TRANSFERRED MY RTI APPLICATION TO LAW OR LEGAL SECTION OF CIC OR TO CIC AND IC SECTION OF CIC WHO INTERPRETS RTI ACT 2005 THROUGH THEIR DECISIONS IN THIS NATION . HENCE THIS FORST APPEAL UNDER SECTION 19 OF RTI ACT. KINDLY PROVIDE ME COORECT AND EXACT INFORMATION MENTIONED AT POINT NUMBER 2 AND 3 OF MY RTI APPLICATION AND ALSO ENSURE THAT DISCIPLINARY ACTION MUST BE TAKEN AGAINST THE ERRING CPIO AND REGISTRATION OF FIRST INFORMATION REPORT MUST BE MADE AGINST THE ERRING CPIO FOR DERILICTION OF HIS OFFICIAL DUTY AS A PUBLIC SERVANT WORKING IN PUBLIC AUTHORITY OF CIC"
DECISION OF FIRST APPELLATE AUTHORITY:
The First Appeal, RTI application and reply given by CPIO of CIC have been perused.
As per Section 2(f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collate information that is not a part of the record.
Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act,2005. Hence, no intervention is required on behalf of the FAA in this matter.
The appeal is disposed of accordingly. |

DECISION OF FIRST APPELLATE AUTHORITY:
The First Appeal, RTI application and reply given by CPIO of CIC have been perused.
