DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal, RTI application and reply given by CPIO of CIC have been perused. As per Section 2(f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collate information that is not a part of the record. Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act,2005. Hence, no intervention is required on behalf of the FAA in this matter. The appeal is disposed of accordingly. NA
454 CICOM/A/P/24/00101 Ms. ROOP AVTAR KAUR 27-08-2024 आर. टी. आई. आवेदन, प्रदान की गई सूचना एवं प्रथम अपील का अवलोकन करने पर पाया गया कि अपीलकर्ता के आर.टी.आई. आवेदन CICOM/R/P/24/00280 के प्रतिउत्तर में केंद्रीय जन सूचना अधिकारी द्वारा प्रेषित की गई सूचना, सूचना का अधिकार अधिनियम के प्रावधानों एवं मांगी गई सूचना के अनुसार ही है। परन्तु आपने अपनी प्रथम अपील में यह कहा है कि मुझे आज तक कोई सूचना नहीं प्रदान की गई है, जबकि केंद्रीय जन सूचना अधिकारी ने 02.08.2024 को ही सूचना दे दी है। जिसकी प्रति प्रथम अपील के आदेश के साथ सलग्न कर दी गई है। अतः केंद्रीय जन सूचना अधिकारी द्वारा प्रदान की गई सूचना तथ्यात्मक है और इसमें प्रथम अपीलीय अधिकारी के हस्तक्षेप की कोई आवश्यकता नहीं है। NA

456 CICOM/A/E/24/00260 Ms. ROOP AVTAR KAUR 24-08-2024 Ref RTI No. - CICOM/R/E/24/01133 GROUNDS FOR FIRST APPEAL: The Appellant submitted first appeal stating that "Reply to Points 1 and 2 of my RTI application is not acceptable as it is out of context for the following reasons:- 1) The information I sought was related to SC directives given in Para 26 of the judgment, to implement the process of the mandate of Sec 4 of RTI Act,2005. The Supreme Court judgment was mentioned in my application. The issue raised before the Hon Supreme Court was whether the public authorities were effectively implementing the necessities of the Sec 4 of the RTI Act,2005. The court ordered the CIC to actively monitor the RTI Acts Sec 4s implementation. In this context, the word monitor means to watch and check the implementation of Sec 4 of RTI Act,2005. Queries in my application were relevant to this issue. 2) I have gone through the Annual Report mentioned in your reply. In this Annual Report, there is no mention of how many public authorities have not implemented Sec 4, and what errors, discrepancies, and shortcomings have been noticed in those who have done so. It is noted that the report does not detail how many public authorities have been cautioned/penalized for non-compliance with Section 4. I think this is what the Supreme Court intended. 3) Considering this the reply of CPIO is out of context. I expect the details of the action taken by CIC in pursuance of Para 26 of the Supreme Court order. The CPIO may therefore be directed to supply the information on what efforts have been made by the CIC to ensure the mandate of Sec 4 of the RTI Act,2005 by the public authorities."
