GROUNDS FOR FIRST APPEAL:
“In the interest of justice, it is humbly prayed:
a) To kindly direct the CPIO to provide para-wise information at the earliest and allow inspection of information requested at para 4 of the Application to the authorized representative ofthe Appellant.
b)To kindly direct the CPIO to submit a sworn affidavit with regard to information requested at para 1,2,3, C5 of the Application.
c) To kindly grant an opportunity of Personal hearing, preferably through video/audio conferencing , in terms of directions contained in F No CIC/CICOM/A/2022/141609 dated 26.02.2024.
d)To kindly adjudicate the instant FA in terms of Sec.19(5) of the RTI Act and pass speaking orders as directed by the Hon’ble Punjab C Haryana High Court in CWP-17672-2023 ,titled Rajwinder Singh Vs State of Punjab.
e) To kindly direct the CPIO to upload the requested information and the Office Oder dated 23.09.2016 on CIC website in terms of Sec.4(1)(b) of the RTI Act.
f) Any other measure, your honour deems fit C proper, to establish a practical regime of RTI Act within the CIC and prevent unwarranted harassment of information seekersâ€
DECISION OF FIRST APPELLATE AUTHORITY:
The First Appeal, RTI application and reply given by CPIO of CIC have been perused.
In the instant appeal, the appellant had requested for personal hearing of the first appeal to which a hearing was scheduled on 21.03.2025 at 04:00 pm via Bharat VC conference. Both the appellant and the CPIO were present in the hearing via VC mode. All the submissions made by the appellant were considered during the decision on the first appeal. During the hearing of the first appeal the appellant made submission that information in whatever format available in respect of Point No. 1 may be given to him.
Point No. 1,
In the instant case, CPIO(Admin) is directed to revisit the RTI application for Point 1 and provide information as per available records as per the provisions of the RTI Act, 2005, by 02.04.2025.
Point No. 2,3 & 5
As per Section 2(f) of the RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collate information that is not a part of the record.
Accordingly, the reply given by the CPIO is appropriate and as per the provisions of the RTI Act, 2005. Hence, no intervention is required on behalf of the FAA in this matter.
Point No. 4
In the instant case, CPIO(Admin) is directed to provide inspection of the file to the appellant only as per the provisions of the RTI Act, 2005.
The appeal is disposed of accordingly. |
