Hence, a copy of the reply to show cause may please be supplied to the appellant. POINT-3: Although they were in question form, the appellant actually requested information about the details of actions taken by the Central Information Commission (CIC) against the CPIO of IIEST, Shibpur. The appellant prayed to issue directives to the CPIO to provide the information immediately. DECISION OF FIRST APPELLATE AUTHORITY: POINTS-2,3&4: CPIO (IC-SP) is directed to provide the information as available in the records, by 29.09.2021 free of cost. NA
2064 CICOM/A/E/21/00186 Ms. ROOP AVTAR KAUR 19-08-2021 Ref: CICOM/R/E/21/00587 dated 29.06.2021. DECISION OF FIRST APPELLATE AUTHORITY: POINT-1&5: As per Section 2(f) of RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collect information that is not a part of the record. He is also not required to interpret information or decision of CIC. Hence, the reply sent by the CPIO, CIC is considered appropriate and as per the provisions of RTI Act, 2005. Therefore, no intervention is required on behalf of the FAA in this matter. POINT-2: CPIO (GA)-CIC is directed to furnish appropriate reply to the appellant for this point by 27.09.021, free of cost. 2065 CICOM/A/P/21/00087 Ms. ROOP AVTAR KAUR 18-08-2021 Ref: CICOM/R/P/21/00341 Grounds for First Appeal: The appellant has mentioned in his first appeal that the information to be supplied is specific, limited, part of instructions/ orders and self-explanatory that does not require to visit the official website for information. The applicant wants certified/attested copies of information. DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal petition, RTI application and reply given by the CPIO-CIC have been perused. With regard to Point-1, once information has been provided in public domain and on the website, the information is no longer held by or under the control of any public authority and hence, is no longer accessible as ‘right to information’. Hence, the reply provided by the CPIO, CIC is as per the provisions of the RTI Act, 2005. As regards points 2 to 5, as per Section 2(f) of RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. GROUNDS FOR FIRST APPEAL: The appellant in his First Appeal dated 15.08.2021 has mentioned as under: “The responding CPIO did not provide me a proper reply, instead, he directs me to study the entire RTI Act, he did not provide an online link to the same. If the CPIO is not the custodian of the information sought, he must have transferred my request to the concerned department, which he did not. So provide me full information within time.” DECISION OF FIRST APPELLATE AUTHORITY: First appeal petition, RTI application and CPIO’s reply have been perused. The appellant may note that he has submitted first appeal with a delay of more than 5 months after due date i.e. 22.02.2021. The RTI Act 2005, RTI Rules 2012 and Compilation of OMs and Notifications are made available on the website of CIC (www.cic.gov.in => “Resources” ) in addition to FAQ. Once information has been provided in public domain and on the website, the information is no longer held by or under the control of any public authority and hence, is no longer accessible as ‘right to information’. The reply of CPIO is considered appropriate and as per provisions of the RTI Act, 2005. Therefore, no intervention is required on behalf of the FAA in this matter. NA
