2113 CICOM/A/P/21/00078 Ms. ROOP AVTAR KAUR 22-07-2021 Grounds for First Appeal: The appellant has submitted that he has not received any reply from the CPIO-CIC so far. He has requested to direct the CPIO to provide information as sought for. DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal petition, RTI application and reply given by the CPIO-CIC have been perused. The appellant may note that information in respect of his RTI request dated 30.03.2021 had been send by CPIO-CIC vide letter No.CICOM/R/P/21/00211 dated 11.05.2021, a copy of which is enclosed herewith. The reply of CPIO-CIC is appropriate and as per the provisions of the RTI Act 2005. The appellant may note that all the decisions of the Commission are available on the website of the Central Information Commission. Once information has been provided in public domain and on the website, the information is no longer held by or under the control of any public authority and hence, is no longer accessible as ‘right to information’. Therefore, no intervention is required on behalf of the FAA in this matter. The appeal is being disposed of accordingly. The appellant has requested to direct the CPIO(s) to provide information as sought for. DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal petition, RTI application and replies given by the CPIOs-CIC in respect of points 1,2,3,4&6 have been perused. The appellant may note that information in respect of his RTI request dated 17.05.2021 had been sent by CPIOs of CIC vide various letters, copies of which are enclosed herewith. The replies of the CPIOs are appropriate and as per the provisions of the RTI Act 2005. The appellant may note that once information has been provided in public domain and on the website, the information is no longer held by or under the control of any public authority and hence, is no longer accessible as ‘right to information’. He has requested to forward a copy of the reply, if already given. DECISION OF FIRST APPELLATE AUTHORITY : The First Appeal petition, RTI application and reply given by the CPIO-CIC have been perused. It is noticed that the CPIO-CIC had responded through RTI portal and no written reply sent to the applicant. In addition to the above, CPIO is directed to provide that portion of the information which is not personal information as per the provisions of the RTI Act 2005, free of cost by 26.08.2021 and also mention the reasons for denial of information, if any. 2116 CICOM/A/E/21/00150 Ms. ROOP AVTAR KAUR 21-07-2021 Grounds for First Appeal: 1. CPIO response, in respect of query in Para 3 and 4 of the RTI Application, is false. 2. Response to query in Para 5 of the RTI request is unsatisfactory. a. The response is in clear violation of sec.7(9) of the RTI Act b. By referring to CIC website, CPIO (M&R), CIC has not vouched for the correctness/accuracy of CIC website. Request to First Appellate Authority 1. Give decision after hearing Appellant personally. 2. To either direct the PIO to provide the information requested vide RTI application or provide information himself under the provisions of RTI Act. DECISION OF FIRST APPELLATE AUTHORITY: The First Appeal petition, RTI application and reply given by the CPIOs-CIC have been perused. As far as Points 3 & 4 are concerned, the CPIO is directed to revisit and give reply in line with FAQ on this point available at Home-page of CIC website, by 10.09.2021. With regard to Point-5, in his reply, the CPIO-CIC had provided CIC website link where CIC provided information on the public domain on the subject in an existing format. As per Section 2(f) of RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collect information that is not a part of the record. Therefore, no intervention is required on behalf of FAA on Point-5. The appeal is being disposed of accordingly. NA

Replies to all questions (Q1-Q5) are informative but can be supported by evidences such as relevant judgements, office orders, Minutes of Meeting, if any. 2119 CICOM/A/E/21/00147 Ms. ROOP AVTAR KAUR 20-07-2021 Grounds for First Appeal: The appellant has mentioned that he is still not in possession of requisite information which was ordered to be provided vide CIC order No.CIC/CBRUI/ A/2019/642731 dated 24.03.2021. DECISION OF FIRST APPELLATE AUTHORITY The First Appeal petition, RTI application and reply given by the CPIO-CIC have been perused. In the “Prayer or Relief sought” portion of the first appeal, the appellant has mentioned about his dissatisfaction regarding the information received by him against his original RTI application in CBI and subsequent second appeal in CIC. It is pertinent to mention here that the present first appeal can be adjudicated by FAA/CIC only for his RTI application in CIC and not CBI. The CPIO-CIC had provided information, vide letter dated 16.07.2021, as available in the records of the Commission with reference to File No.CIC/CBRUI/A/2019/642732. However, at sl.no.2, the appellant had requested information relating to File No. CIC/CBRUI/A/2019/642731. It seems that CPIO-CIC has replied considering the file No. CIC/CBRUI/A/2019/642732. Accordingly, the CPIO-CIC is directed to revisit and provide information free of cost by 31.08.2021, as asked for by the appellant in his RTI request, as per provisions of the RTI Act 2005. 2120 CICOM/A/E/21/00146 Ms. ROOP AVTAR KAUR 17-07-2021 ऑनलाइन आर. टी. आई. आवेदन, प्रदान की गई सूचना एवं प्रथम अपील का अवलोकन करने पर पाया गया कि अपीलकर्ता के आर.टी.आई. आवेदन सं. CICOM/R/E/21/00551 के प्रतिउत्तर में केंद्रीय जन सूचना अधिकारी (Admin) द्वारा प्रेषित की गई सूचना, सूचना का अधिकार अधिनियम के प्रावधानों एवं मांगी गई सूचना के अनुसार ही है। उल्लेखनीय है कि सूचना अधिकार अधिकारी अधिनियम की धारा 2 (च) के प्रावधानों के अनुसार एक जन सूचना अधिकारी केवल सम्बंधित लोक प्राधिकरण के रिकॉर्ड में एक सामग्री के रूप में उपलब्ध सूचना ही प्रदान कर सकता है। अतः केंद्रीय जन सूचना अधिकारी द्वारा प्रदान की गई सूचना तथ्यात्मक है और इसमें प्रथम अपीलीय अधिकारी के हस्तक्षेप की कोई आवश्यकता नहीं है। NA
