III. In his First Appeals dated 05.05.2021 & 31.05.2021, the Appellant has mentioned that the concerned CPIO(s) had refused/denied to provide information on points 3, 5 & 6, and provided incomplete information on points 4 & 10. Complete details available in the online first appeals. IV. The First Appeal petitions, RTI application and replies given by the CPIOs have been seen. Point-3: As per Section 2(f) of RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collect information that is not a part of the record. However, the CPIO (DS-P&B) is directed to revisit and give reply to the appellant in compliance with Sec.4(b)(xi) of RTI Act, 2005. Point-4: The CPIO (SO-Admn) is directed to revisit and provide information in the form as available in the records. Point-5: The CPIO (SO-Admn) is directed to revisit and provide information in compliance with Section 4(b)(x) of RTI Act 2005 with due application of Section 8(j). The applicant vide RTI application No. CICOM/R/E/21/00360 dated 15.04.2021 had sought information relating to status of his email dated 13.03.2021 addressed to Secretary, CIC. II. The CPIO, RTI Cell, CIC had attached the information received from the office of Secretary wherein it was mentioned that no such information available in the office of Secretary, CIC. III. In his First Appeal dated 24.05.2021, the Appellant has mentioned that no response within the time limit. IV. The First Appeal petition, RTI application and reply given by the CPIO have been seen. Section 2(f) of RTI Act, 2005 states, “information” means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force.” In the subject matter, FAA is of the opinion that the information/replies provided by the CPIOs are appropriate and as per the provisions of the RTI Act, 2005.
