The applicant vide RTI application No. CICOM/R/E/21/00400 dated 30.04.2021 had sought information relating to List of PAs under CIC, List of CICs/ICs worked in the CIC so far and disposal of appeals / complaints during their respective tenures, year-wise penalties awarded by the Commission so far, year-wise action taken against PAs so far and total no. of PAs checked for compliance of Section 4 so far. II. The following CPIOs have given replies/ information. 1) Shri Devender Kumar, CPIO – M&R Section vide letter dated 10.05.2021. 2) Shri Ram Kumar, CPIO: CR-II Section vide letter dated 18.05.2021. III. In his First Appeal dated 18.05.2021, the Appellant has mentioned that insufficient information provided. IV. The First Appeal petitions, RTI application and replies given by the CPIOs have been seen. The replies/information provided by the CPIOs in respect of points 1,3,4 & 5 are appropriate and as per the provisions of the RTI Act, 2005. As per Section 2(f) of RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collect information that is not a part of the record. 2194 CICOM/A/E/21/00086 Ms. ROOP AVTAR KAUR 18-05-2021 I. The applicant vide RTI application No. CICOM/R/E/21/00401 had sought information relating to CIC Annual Report 2020-2021, details of cases – registered/disposed/pending – action taken by CIC for recovery of penalties and action taken in respect of PAs who did not submit quarterly reports and action taken by the CIC towards PAs who did not submit transparency Audit reports for the periods 2018-19, 2019-20 & 2020-21. II. The following CPIOs have given replies/ information. 1) Shri Devender Kumar, CPIO – M&R Section vide letter dated 10.05.2021. 2) Shri Ram Kumar, CPIO: CR-II Section vide letter dated 18.05.2021. 3) Shri Manoj Kumar Gupta, CPIO (SO-Legal Section) on 02.06.2021. III. In his First Appeals dated 10.05.2021 & 18.05.2021, the Appellant has mentioned that insufficient information provided in respect of points 1-4 and reply to point-3 is confusing. IV. The First Appeal petitions, RTI application and replies given by the CPIOs have been seen. The replies/information provided by the CPIOs in respect of points 1,2,4 & 5 are appropriate and as per the provisions of the RTI Act, 2005. Point-3: As per Section 2(f) of RTI Act, 2005 only such information as is available and existing and held by the public authority or is under control of the public authority can be provided by a PIO. The PIO is not supposed to create or collect information that is not a part of the record. However, the CPIO (SO-M&R) is hereby directed to revisit the reply and provide suitable information, within 10 days from the date of issue of this decision. V. The appeal is being disposed of accordingly. NA

CICOM/R/E/21/00358 के प्रतिउत्तर में केंद्रीय जन सूचना अधिकारी (Admin) द्वारा प्रेषित की गई सूचना, सूचना का अधिकार अधिनियम, 2005 के प्रावधानों के अनुसार ही है, इसलिय इस मामले में प्रथम अपीलीय अधिकारी के हस्तक्षेप की कोई आवश्यकता नहीं है। प्रथम अपील में उल्लेखित अन्य मदें जो कि RTI आवेदन का हिस्सा नहीं है, तथा उस पर प्रथम अपीलीय अधिकारी द्वारा कोई कार्यवाही अपेक्षित नहीं है। NA
