2172 CICOM/A/E/21/00108 Ms. ROOP AVTAR KAUR 05-06-2021 I. The applicant vide RTI application No. CICOM/R/E/21/00438 dated 12.05.2021 had sought information as under: “1. Name the Documents which are mandatory for making Income and Asset Certificate for EWS category. 2. If registry of Property is mandatory, then what to do if a person is living in the LAL LAKIR Property. 3. If any authority denies to make this certificate for not producing any document which is not mandatory to attach with the file, where to complain in that case. 4. Is there any separate rule or criteria for making this certificate throughout the India or State may issue other guidelines for making this certificate.” II. Shri Ram Kumar, CPIO, CIC had given online reply on 31.05.2021 mentioning that no information was available. III. In his First Appeal dated 05.06.2021, the Appellant has reiterated his request for the above information. IV. The First Appeal petition, RTI application and reply given by the CPIO have been seen. The applicant vide RTI application No. CICOM/R/E/21/00459 dated 20.05.2021 had sought information as under: “wife, son and daughter can treat third party when he seeks or take personal information, pensionary benefits and service book copy of his deceased husband/father. As per decision of Supreme Court dated 13-11-2019 of civil appeal 10044 of 2010. So please provide rule copy of take personal information of his deceased husband/father.” II. Shri Ram Kumar, CPIO, CIC had given online reply on 24.05.2021 mentioning that no rule copy is available other than RTI Act, 2005 which is available in public domain. III. In his First Appeal dated 04.06.2021, the Appellant mentioned as under: “Wife can be treated as third party when he seeks information about the pensionary benefits of his deceased Husband in RTI Act-2005. So pls provide the notification/Rule copy of the wife take information about the pensionary benefits of his deceased Husband.” IV. Section 2(f) of RTI Act, 2005 states, “information” means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force.” In the subject matter, FAA is of the opinion that the information/replies provided by the CPIOs are appropriate and as per the provisions of the RTI Act, 2005. The applicant has requested information vide RTI application No. CICOM/R/E/21/00348 received by the CPIOs of the Commission on 12.04.2021 inter alia with regard to audio video records of hearings in the Commission, details of Shri Neeraj Kumar Gupta, IC & his staff and information relating to disposal of Second Appeals & complaints by him. II.
